1.) I am appealing the constructive denial of my FOIL request, originally submitted on 05/20/2022.

2.) On 05/20/2022 a FOIL request was submitted via email to john.greenan@erie.gov for "Any and all police reports, complaints, and narratives regarding the following subject: Danielle Cretacci"

3.) As of today 6/14/2022, the Erie County Sheriff's Department has failed to acknowledge my request. When an agency receives a request, §89(3)(a) of the Freedom of Information Law requires that it has five business days to grant or deny access in whole or in part, or if more time is needed, to acknowledge the receipt of the request in writing and indicate an approximate date by which the agency will respond to the request.

I am requesting the Erie County Sheriffs Office certify that it does not have possession of such records or that such record cannot be found after a diligent search pursuant to NYS FOIL §89 3. (a). As you have already stated you will not certify, please forward me the appeal information (name and business address my appeal can be directed to). Thank you.

Ms. Riford: Please understand that ECSO has run a complete search regarding Ms. Cretacci’s and we do not possess any files responsive to your request - "Any and all police reports, complaints, and narratives regarding the following subject: Danielle Cretacci"
Not having a file is not a denial, therefore no certification will be provided.

Ms. Cretacci lived in Buffalo and/or Tonawanda and was killed in Tonawanda NY. Per an article on WIVB.com, Tonawanda PD investigated this case. Please consider FOILing Tonawanda PD and/or Buffalo PD, as these are the LE agencies who may have any files that you seek.

There is also no appeal process when our agency has run a search(es) with zero hits on the subjects name. Although we are a county agency, we do not have any access to records owned and maintained by municipalities with their own police agency.
