Pursuant to the state open records law, Ariz. Rev. Stat. Ann. Secs. 39-121 to 39-122 and 39-128, I hereby request the following records:

A list or log of U.S. Immigration and Customs Enforcement referrals made by the Eloy Police Department since January 2009 grouped by month, year, and reason for arrest, reason for referral, and whether ICE took custody of the arrestee or not. If no such log is kept, please perform a word search on the police reporting system, using keywords: Immigration, ICE and detainer, and provide copies of records that indicate a referral was made to ICE.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

Unfortunately our agency does not log arrests by immigration status so it will be a very lengthy process gathering the information you requested as I will have to physically look at each and every arrest in the system to determine what the arrest was for.

There is a fee of $7.50 per report up to 25 pages. Please let me know how you would like to proceed. If you choose to continue I will gather the information and let you know how much the total for the reports will be before I process the request.
