Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

Any and all statistics, data, reports, audits, policies, and procedures pertaining to the following items regarding sexual assault evidence collection (SAEC) kits (also known as "rape kits") and processing:

• all standard operating procedures regarding the SAEC process

• any written policies or procedures regarding department practices on the acquisition of or handling of rape kit evidence, including protocols for its collection, testing, and delegation and transfer to all other possibly relevant locations, laboratories, or agencies

• the number of kits collected and booked into evidence from the period of January 1, 2000 through the date this request is processed

• the number of kits that have been processed by a public or private crime or forensic laboratory or equivalent processing location from the period of January 1, 2000 through the date this request is processed

• the number of unprocessed kits in any storage facilities currently under the department’s jurisdiction and control, including those held by medical personnel or at external laboratory locations

• any materials regarding the status or ultimate disposition of cases in which a kit was collected. Please include all available segregable data.

• all audits involving this agency regarding the collection or backlog of SAEC kits

• all proposed alterations or yet-to-be-implemented changes to the policies and procedures regarding the collection, testing, and use of SAEC kits

Hello I am receipt of your request please be advised that we are small agency and we do not have many rapes if any on a given year. All of our kits are submitted to the forensic unit of the state police when we do have a rape. There will not be much data associated with the request. Pursuant to nys executive law all kits are submitted for testing. Since we are small what specifically can I provide to you in your request to simplify and speed it up for you. Ty CHief

Would you be able to just focus on these points of the request?

• the number of kits that have been processed by a public or private crime or forensic laboratory or equivalent processing location from the period of January 1, 2000 through the date this request is processed

• the number of unprocessed kits in any storage facilities currently under the department’s jurisdiction and control, including those held by medical personnel or at external laboratory locations. (You've said you send all kits to the forensic unit of the state police, so am I correct in saying you do not have a backlog of unprocessed rape kits?)

Hi:
Most all of this is workable to the point from 2010 through now as we were
only outfitted with computers effective September 2010 for our records
keeping systems. In August 2011 our entire Police station was destroyed by
flooding waters from Hurricane Irene which included our records room that
had all our manually kept records prior to 2010 were destroyed. So I can
only provide you with records from 2010 through the present day as they
were all kept by computer. So that being said all the info you requested
will be provided from the dates above through present. If this is a
problem let me know before we compile this info for you. If not I will get
this to you within the next two weeks. Thank You Chief Mattracion

Your foil request information is now complete-Please see below for details
and a copy of all info has been sent by US Mail to your office.

Included in your request is a copy of of our policies and procedures in
regards to Sex Assault kits under Policy #730,in addition to our Sex
Victims policy and evidence policy. All of our evidence for sex kits, DNA,
Blood etc is sent to the New York State Police Lab in Newburgh NY for
testing. All kits are collected by a SANE(Sexual Assault Nursing Exam)
unit Nurse at either Kingston City Hospital or St Francis Hospital in
Poughkeepsie, and all exams are done by a member of that unit with crime
victims unit member present during same, and collected in accordance with
their protocols and that of the Ulster County District Attorneys Office.
All kits collected by this agency have been tested and there are no
unprocessed kits in our possession pursuant to our policies and the number
of kits collected is 21. I want to thank you for patience in this matter
and if you have any further questions please contact me.
