Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:

Any and all contracts (as well as all associated amendments, exhibits, and materials), memorandums of understanding, and other equivalent agreements entered into by this agency with or any other social media surveillance software or equipment company, including but not limited to:

• BrightPlanet
• Geofeedia
• Intrado Inc.
• LifeRaft
• Magnet Forensics
• Media Sonar
• Signal Corporation
• ZeroFOX

Responsive materials should include but not be limited to:

• the initial Invitation to Bid, Request for Proposal, or equivalent call for contractors
• the responsive materials provided by the winning bidder
• other bidder responses
• the current contract
• all exhibits
• all amendments
• all performance work statements
• all deliverables inventories
• all invoices related to the deliverance of software, services, or goods

Please also include:

• all policies related to the acquisition and use of social media and surveillance software by individual officers and representatives of this agency
• all materials related to the use of any other social media platform, including but not limited to Facebook, Instagram, Twitter, Nextdoor, etc.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Sir or Madam,

This email is in reference to your public disclosure request sent via email to the Ellensburg Police Department on February 6, 2017. After contacting the Ellensburg Police Department’s Operations Captain, Administrative Captain and Detective Sergeant, it has been determined that the Ellensburg Police Department does not utilize social media monitoring systems. Therefore, we do not have any documents responsive to your request.

I want to further point out that I am responding to the ONLY email request that has been received by our agency from you. I see that your email includes multiple “forwards” and I want to advise you that we have not received any previous email from you, thus, we are responding in a timely manner per Washington State Law.

The foregoing is intended to complete the Police Department’s response to your records request. If for any reason you believe the Department has not fully responded to your request, you may file a written appeal with the City of Ellensburg’s Public Records Officer, Terry Weiner. The appeal should include your name and address, a copy of the document if available, and a copy of this letter together with a brief statement of the reasons why you believe the Department has not fully or properly responded to your request.
