Pursuant to the West Virginia Freedom of Information Act and the West Virginia Open Governmental Proceedings Act, I hereby request the following records:
All calls for service related to activities conducted at Huttonsville Correctional Center from January 1, 2010 to the day this request is processed.
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Ms. Lipton:
We are in receipt of a FOIA request from you, received February 17, 2015 (and referred to internally as City of Elkins FOIA Request 2015-02) for “All calls for service related to activities conducted at Huttonsville Correctional Center from January 1, 2010 to the day this request is processed.”
Please be advised that the Huttonsville Correctional Center is outside of Elkins city limits. Therefore, the Elkins Police Department would neither receive nor respond to calls for service from that location.
With this message, the City of Elkins considers this request for public records closed and asserts that we are under no further obligation to produce records or documents in answer thereto. As permitted under West Virginia Code section 29B-1-3(4)c, you have the right to institute proceedings seeking injunctive or declaratory relief in Randolph County Circuit Court.
