Pursuant to the California Public Records Act, I hereby request the following records:

1. the total number of civilian complaints alleging any form of law enforcement misconduct that were reported and the total number sustained in 2021.

2. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained in 2021.

3. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained in 2021.

4. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained in 2021.

5. the total number of officer involved shootings in 2021, both fatal and non-fatal.

When available, I would appreciate being sent individualized data for each item in this request in spreadsheet format. If individualized data are unavailable, please send information that includes aggregate statistics for the item instead.

Note that my requests for civilian complaints are specifically for civilian complaints alleging police misconduct, please do not include complaints filed by one officer/the department against another officer.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Good afternoon,

The City of Elk Grove has identified records responsive to your request for public records received on June 21, 2022. These records will be produced in accordance with Government Code Section 6253 unless it is determined that an exemption within the California Public Records Act justifies non-disclosure of the information.

The City attempts to provide records in electronic format whenever possible to avoid the cost of duplication and mailing; however, the City may require payment of all costs of duplication and other costs that are subject to reimbursement, as authorized by Government Code section 6253(b) and other relevant law, prior to the release of any copied records. We will contact you in advance if we determine the fees will exceed $50.

Good morning -

This email responds to your request for public records received by the City on June 21, 2022.

There have been no civilian complaints alleging law enforcement use of excessive force, biased policing or racial profiling that were sustained in 2021. There were also no officer involved shootings in 2021. The remainder of the information requested is exempt pursuant to Penal Code section 832.7, Government Code section 6254, Evidence Code section 1040 and 71 Ops. Cal. Atty. Gen. 247.

Please note that nothing in the Public Records Act requires the City to create a log of documents exempt from disclosure (Haynie v. Superior Court (2001) 26 Cal. 4th 1061, 1073, 31 P.3d 760 The determination regarding the exemption of records was made by Deputy City Attorney Chelsea Mejia pursuant to Government Code section 6253(d).

This completes the City's response to this request for public records.
