Good afternoon,

Your Request for Public Records dated April 16, 2021, was received in the Office of the City Clerk of the City of Elk Grove on May 4, 2021. Please note that the original request you indicate was submitted on February 8, 2021, was not received by the City Clerk. This request is seeking records related to Automated License Plate Reader (ALPR) data sharing.

In response to that Request, and pursuant to Government Code section 6253(c), this letter serves to advise you that it appears the Request, in whole or in part, seeks copies of disclosable public records that may be in the possession of the City, as provided by the Public Records Act, Government Code sections 6250 et seq. (the "PRA"). However, the Request may also seek copies of records that are exempt from disclosure under the provisions of the PRA, including, but not limited to, the exemptions set forth at Government Code sections 6254 and 6255.

The City will begin identifying the specific records, if any, which are responsive to the Request, and will make diligent efforts to ensure that all disclosable records will be made available to you as soon as possible. We anticipate that disclosable records can be available by June 11, 2021; if additional time is necessary, we will so notify you.
The City attempts to provide records in electronic format whenever possible to avoid the cost of duplication and mailing; however, should you choose to receive physical copies of any disclosable records, the City will require payment of all costs of duplication, as authorized by Government Code section 6253(b), prior to the release of any copied records. We will contact you in advance if we determine the fees will exceed $50.

Please let me know if you have any questions or need additional information at this time. Please reference RFI-21-109 when inquiring about this item.

From: Elk Grove Police Department

Good afternoon,

The City of Elk Grove has identified records responsive to your request received on May 4, 2021, seeking records related to Automated License Plate Reader (ALPR) data sharing. These records are being withheld by the City pursuant to Government Code sections 6254(k), 6255 and Civil Code section 1798.90.55.

Please note that nothing in the Public Records Act requires the City to create a log of documents exempt from disclosure (Haynie v. Superior Court (2001) 26 Cal. 4th 1061, 1073, 31 P.3d 760). The determination regarding the exemption of records was made by Deputy City Attorney Chelsea Mejia pursuant to Government Code section 6253(d).

Please let me know if you need additional information at this time; this completes the City's response to this request for public records.

Thank you.
