Pursuant to the New Mexico Inspection of Public Records Act, I hereby request the following documents:

• All agreements between this agency and any federal agency for operations and activities related to Operation Desert Snow.

• All arrest reports for apprehensions conducted as part of Operation Desert Snow. [For reference: http://www.usmarshals.gov/news/chron/2015/060815a.htm]

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Mr. Lipton,

I sincerely apologize for the confusion in this matter. The Eddy County Sheriff's Office part in this operation was small at best. There was a verbal agreement made for an agency assist between the sheriff and the Marshal's Service for the operation as it pertained to Eddy County. We provided 3 or 4 uniformed deputies to assist in location of addresses and transport of federal prisoners to the detention center. To my knowledge, deputies made no arrests, had no use of force incidents and wrote no reports due to their limited involvement. This was basically a courtesy assist to the Marshal's Service on the sheriff's behalf as they were conducting an operation within Eddy County.

I again apologize for the drawn out process that this became. I hope I have answered your initial request to your satisfaction. Please contact me directly at this email address if there is anything else I can clarify on this matter.

As Chief Cage mentioned, ECSO's involvement was minimal, providing only limited manpower. We did not generate any reports for the operation (Chief Cage, please correct me if I'm wrong). Therefore, we have no records to disclose. If you're seeking radio logs to see who was helping on that date and time, you may trying submitting your request to Robbie McCormick (cc'ed above). She is the Director of the Regional Emergency Dispatch Authority (the dispatch center we contract with). She may be able to process your request.

If this does not satisfy your request, please be more specific in the information you're seeking. Otherwise, we will consider this matter closed.

Gentlemen,

I will be referring Mr. Lipton to our website for completion of a REDA
records request.

Following receipt, this agency will conduct a search of related records of
call according to the reasonable specificity required in the FOIA.

Unfortunately the request at present does not provide enough detail (dates,
persons, nature of call, etc) to do an accurate search of POSSIBLE related
documents.

REDA also would not be able to supply any MOU or other agreements on behalf
of the ECSO and other entities.

As you know, federal operations in our area, although utilizing local
communications resources, are not always fully known to the communication
center due to opsec and other factors. Meaning that, unless any possible
record of call is explicit to that operation, it will not be released.
