From: PRA Audit

To Whom It May Concern:

Pursuant to the Washington Public Records Act [RCW 42.56] I hereby request the following records:

I request a complete electronic copy of all Public Records Requests received by Eatonville School District and a complete electronic copy of the District's Responses to these Public Records Requests for the time period January 1, 2010 through November 4, 2021.

In the event the District chooses to provide these records in installments over time I request the records to be produced in reverse chronological order - from the most recent records to the earliest.

If this request is denied in whole or part, I ask that you justify all deletions by reference to specific exemptions of the PRA. I also request a detailed contemporaneous log to be provided for any document withheld or redacted.

For each responsive record the District contends is exempt from public disclosure, in whole or in part, please specifically identify the record by subject, title, author, custodian and date, and state how a specific statutory exemption applies to each record as required by RCW 42.56.210(3) and Rental Housing Ass'n v. Des Moines, 165 Wn.2d 525, 199 P.3d 393 (2009).

I request electronic production of all electronic records in the original NATIVE electronic format for each record.

I request for these public records to be produced by public (no password) e-mail attachment or link. If electronic attachment or link is not possible, an alternative would be to produce responsive records via USB DRIVE or DATA CD-ROM.

THIS REQUEST IS NOT BEING MADE FOR COMMERCIAL PURPOSES.

The requested documents will be made available to the general public.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Sincerely,

PRA Audit

Hello,

I am emailing to inform you that we have not received either payment for
the Public Records Request RE: Public Records Requests received by
Eatonville School District.

I have reviewed communications on the Muckrock website verifying that two
separate checks were sent in the amounts requested for the totals of both
installments. One dated 12/10/2021 and the second dated 12/17/2021.

This message is to inform you that we have not yet received either of those
checks through the district office for processing yet. I am hoping you may
be able to provide additional information as to whether those funds were
sent using some sort of tracking number or through certified mail so as to
be able to determine the delay.

Our intention is to work with you to provide the required documentation you
have requested, but to also make you aware that we have not received
payment for that request yet. Please let me know if there is any way I can
assist any further, or if you are able to provide additional information as
to when payments were sent.

Thank you for your communication regarding this matter.

Hello,

This email is to verify that both checks; #10288 in the amount of $28.00
and #10289 in the amount of $66.30 have been received.

I am now working to determine mailing/shipping costs for those records to
be sent to you. To be able to accurately estimate the cost of shipping, can
you please provide a valid address as to where you would like the
documents pertaining to your records request sent to. This information will
help to determine correct shipping costs.

Per district policy and procedures the district charges mailing costs. I
have posted the procedure from our district website below, as well as a
link as to where you can review the procedure document.

https://drive.google.com/drive/folders/0B9dzDShhC0znaWFMYl90ZFNxQ1k?resourcekey=0-CmWJZEwVAYUl_EqOW35MVQ

*Costs of Printed Copies and Mailing*

*The cost of providing photocopies or printed copies of electronic records
is .15 cents per page. Alternatively, if the District determines and
documents that the fees allowed under this procedure are clearly equal to,
or more than, two dollars, the District may instead charge a flat fee of
two dollars to provide the records. If the District charges a flat fee for
the first installment, the District will not charge an additional flat fee
or a per page fee for any subsequent installments. Payment may be made by
cash, check or money order payable to the District. The District may also
charge actual cost of mailing, including the cost of the shipping container
or envelope. The Public Records Officer or designee may require the payment
of the remainder of the copying costs before providing all the records, or
the payment of the costs of copying an installment before providing that
installment. If requested, the District will provide a summary of the
applicable charges before any copies are made. The requestor will be
allowed to revise the request in order to reduce the applicable charges. *

When the address is received, I will provide information on the final costs
associated with your public records request. Once the total amount of
shipping costs is received by the district, the entirety of the Public
Records Request of 2122-005 will be sent directly to the address along with
a certified record receipt that it has been received.

Subject: RE: Washington Public Records Act Request 11-4-2021

Hello,

Some questions:

When can we expect to begin to receive production of responsive documents in original NATIVE electronic format for each record as originally requested as our fees have been pre paid? The installments we have received thus far appear to be new records created specifically by the District which is not what was requested.

For example it appears that many of the records produced to date are copies of emails that have been modified from their original NATIVE electronic email format by PRINTING the original email and then SCANNING the email and then applying a .10c per page fee to produce as an installment what is now a NEW RECORD that was never requested, meanwhile silently withholding the original NATIVE copies of the responsive public documents that were originally requested.

Fees for records production should have been calculated at .04 cents per ELECTRONIC attachment for the production of responsive public records in installments over time as originally requested to be produced in reverse chronological order - from the most recent records to the earliest. Emails are preferred to be produced in NATIVE .pst format or .pdf or .mbox or .eml, or .msg, in that preferred order of format based on the software and tools currently in common usage at the District for email processing, archiving, and workflows.

Please explain.

Thank you.

Dear Sir or Madam:

The purpose of this letter is to notify you that we have completed our
search for records responsive to your request for copies of the District’s
responses to public records requests from January 1, 2010 to November 4,
2021. Please note, however, that the District retains public record
requests for two years, which is in accordance with the record retention
guidelines for school districts established by the Washington Secretary of
State.

Previously, the District provided you with responsive records in PDF
format, because that was the format for the records originally produced in
response to the prior public record requests that are the subject of your
request.

From: PRA Audit

Hello,

This response does not even begin to answer *ANY* of my questions.

I requested NATIVE copies of records held in electronic storage. Does your agency keep records in electronic storage? On hard drives? Servers? Email?

1. What NATIVE copies of electronic records has your agency produced to date?
2. What scanned pages of records that ONLY EXIST IN PRINT FORM has your agency produced to date?
3. How Many pages of electronic records has your agency PRINTED and then SCANNED and produced to date?

Thank you

From: Eatonville School District

Hello,

It has come to my attention that you may not have received my full email.
Upon tracking the responses on the muckrock website, I can only see a small
portion of my response to your request for native format. I have cut and
pasted a copy of the email below to be able to be seen as well as attached
a PDF copy of the email as well in an additional attempt to ensure that you
have received it and the link it provides.
