Pursuant to Pennsylvania Right to Know Act, I hereby request the following records:

Any and all contracts (as well as all associated amendments, exhibits, and materials), memorandums of understanding, and other equivalent agreements entered into by this agency with or any other social media surveillance software or equipment company, including but not limited to:

• BrightPlanet
• Geofeedia
• Intrado Inc.
• LifeRaft
• Magnet Forensics
• Media Sonar
• Signal Corporation
• ZeroFOX

Responsive materials should include but not be limited to:

• the initial Invitation to Bid, Request for Proposal, or equivalent call for contractors
• the responsive materials provided by the winning bidder
• other bidder responses
• the current contract
• all exhibits
• all amendments
• all performance work statements
• all deliverables inventories
• all invoices related to the deliverance of software, services, or goods

Please also include:

• all policies related to the acquisition and use of social media and surveillance software by individual officers and representatives of this agency
• all materials related to the use of any other social media platform, including but not limited to Facebook, Instagram, Twitter, Nextdoor, etc.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Can you please explain exactly what you are looking for? I don’t use any social media surveillance software. I have a basic policy on how employees may use social media to engage the community but we don’t do any surveillance with social media software.

I am the Township's right to know officer and wanted to advise you that I received your request for records via the Chief of Police on Friday, 1/27/2017.
Therefore the official date of request is 1/27/2017 in which you requested:

1. Any and all contracts (as well as all associated amendments, exhibits, and materials), memorandums of understanding, and other equivalent agreements entered into by this agency with or any other social media surveillance software or equipment company, including but not limited to:

2. all policies related to the acquisition and use of social media and surveillance software by individual officers and representatives of this agency.

In response to your request as outline above:

1. The Township does not hold contracts with any of the noted companies nor any other 'social media surveillance software or equipment' so your request for this item is denied due to lack of records.

2./3. I've provided a copy of the Police Department's Social Media policy but I am unclear if this is what you were seeking with either item 2 or 3.
Please do not hesitate to contact me in the future should you need further assistance or additional records.

You have a right to appeal this determination of information in writing to the attention of: Executive Director, Office of Open Records, Commonwealth Keystone Building, 400 North Street, 4th Floor, Harrisburg, PA 17120.
If you choose to file an appeal you must do so within 15 business days of the mailing date of the agency's response (Section 1101).
