Pursuant to the New York Freedom of Information Law, I hereby request the following records:

A recent report by Buzzfeed News indicates that the Dutchess County Sheriff's department has used Clearview AI for Facial Recognition. I am requesting documents pertaining to Clearview AI (https://clearview.ai/). This should include - but is not limited to - the following:

- Any internal briefs and/or memos referencing Clearview AI's products and/or services
- Any use guides, FAQs, and/or manuals for Clearview AI's products and/or services
- Any documents highlighting internal use cases for Clearview AI's products and/or services
- Any use policies and/or data retention polices for Clearview AI's products and/or services
- A copy of all emails to any agency staff from an address within the *@clearview.ai domain

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

This to acknowledge receipt of your FOIL request dated April 6, 2021, requesting information that the Dutchess County Sheriff's Office has used Clearview AI for facial recognition (email thread attached). Please be advised that the Dutchess County Sheriff's Office does not possess or have the capability to utilize facial recognition. Thank you.

Please take notice that you may within thirty days appeal in writing this response pursuant to NY Public Officers Law Section 89(4)(a) to the Dutchess County Attorney, James M. Fedorchak, 22 Market Street, Poughkeepsie, NY 12601, tel. (845) 486-2110. The original FOIL request and response should accompany the appeal. An appeal is not complete unless it contains

1. the date and location of requests for records;
2. a description, to the extent possible, of the records that were denied; and
3. the name and return address of the appellant.
