Pursuant to the DC Freedom of Information Act, I hereby request the following records:

The following materials regarding the imposition, assessment, collection and balances of inmate fees and debt:

All current policies and procedures regarding medical and room & board costs or fees for which inmates are or may become liable. Please include all policies and procedures related to how fees are set, accrued, imposed, collected, and enforced (such as those related to per diem fees, ability to pay determinations, penalties for late or non-payment, authorization for civil or criminal action for payment enforcement, etc).

All reports, databases, spreadsheets, or equivalent materials regarding debts/restitution paid to or owed to this department or any facility/agency under its jurisdiction in FY2021. Please include all relevant data regarding medical and room & board costs, including the number of individuals charged for medical and room & board costs or fees and the total amount of medical and room & board fees imposed in FY2021.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

This is in response to your Freedom of Information Act request that was received on December 19, 2022 and assigned Tracking # 2022-12-19-2964F.

Please note that, under the policy of the DC Department of Corrections (DOC), Program Manual 6000.1l (Medical Management), DOC "inmates are not required to make medical co-payments...." You may obtain PM 6000.1l at https://doc.dc.gov/page/doc-program-statements. Note, also, that inmates do not incur "board costs or fees."

Further, no additional responsive DOC records were found.

If you consider this response a denial of your FOIA request, you are advised of your right under D.C. Official Code ยง 2-537 and 1 DCMR 412 to appeal to the Mayor or to the Superior Court of the District of Columbia.

If you elect to appeal to the Mayor, your appeal must be in writing and contain "Freedom of Information Act Appeal" or "FOIA Appeal" in the subject line of the letter as well as on the outside of the envelope. The appeal must include (1) a copy of the original request, (2) a copy of this letter, (3) a statement of the circumstances, reasons, and or arguments advanced in support of disclosure, and (4) a daytime telephone number, and e-mail and/or U.S. Mail address at which you can be reached.
