To whom it may concern,
Pursuant to Massachusetts General Law Chapter 66, Section 10, I'm requesting all executive session minutes generated, by the Dighton Board of Selectmen for the years 2010 through the of end 2015.
Massachusetts law requires that executive session minutes be reviewed and released regularly, and that once the stated purpose for a particular executive session has ended, the minutes of the executive sessions are to be made public. Once released, I plan to make the information available to the public online, free of charge.
Please be advised that denial of this request, or redactions made to released materials must be accompanied by citations of the exemptions you believe allow you to withhold the information requested.
I'm requesting that any fees be waived, as I believe the release of these materials is in the public interest, however, if fees cannot be waived, I ask that you include a good faith estimate of the anticipated fees in your response. I also request that the materials be provided electronically in an email attachment, or if that is not possible, on a CD-ROM. If neither of these options are available, I'd be happy to receive the documents via snail mail, or come to your municipal offices in person to pick them up.

I apologize if I was unclear in my previous email. I'm requesting that the Board review the minutes, determine which are appropriate for release, and if it withholds any or all of the minutes, I'm asking that the Board cite the exemptions under the Massachusetts Public Records Law which allows it to do so. Massachusetts General Law Chapter 30A, Section 22 requires that the Board review executive session minutes at "reasonable intervals", and I think it is reasonable to call 5-6 years a more than reasonable interval. If the Board is unwilling or unable to comply with the request, I'll be filing an appeal with the Supervisor of Records, so please let me know if the Board changes its position. Thank you.

I’m appealing the rejection of a public records request for the review and release of Board of Selectmen executive session minutes for the years 2010-2015. I believe the records custodian’s failure to respond to numerous follow up requests after providing a tiny portion of the documents requested constitutes a rejection of the request.

I apologize for any confusion that I may have caused with the response provided to your records request of July 10, 2016. The minutes that were provided to you were all of the minutes that could be released to the public. It is the board of selectmen's position that the rest of the requested minutes are related to grievances filed or pending litigation and cannot be released as public information.
I should have issued an additional response outlining their position as a follow up to my email of 8/16 which implied that there would be more minutes to follow.
I apologize for any inconvenience that this oversight may have caused.
