The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Kory Saulnier,

This will confirm receipt of your open records request to the City of Des Moines dated September 24, 2020. Your request has been forwarded to me for response. An assessment is underway to determine staff services and costs to fulfill this request.

According to the policy of the City of Des Moines, the first 15 minutes of staff time towards determining and fulfilling a request is without charge; however, staff time spent on a records search beyond 15 minutes is calculated by multiplying the base hourly wage of all of the employees who work on the request times the number of hours spent on the search to the nearest quarter-hour increment. Fees are charged for copying, faxing, document scanning, CDs, postage and other costs when applicable. A deposit of one-half of the estimated cost of fulfillment must be submitted to the City of Des Moines prior to further staff time being expended on the search. It is anticipated that an estimate will be available within the next week and, once available, it will be forwarded to you for payment. The remainder due will be calculated by the actual amount of time expended and any copy fees, etc., required to fulfill the request and will be due prior to receiving the documents.

Thank you for your inquiry as to the status of your open records request to the City of Des Moines. There are a large number of documents responsive to this request, and it has taken some time to review all documents for confidentiality requirements.

I have attached to this email all responsive documents which can be provided at this time without cost to you. Much of the requested documents/proposals contain confidentiality requirements and, pursuant to Section 8 of the Standard Provisions and Requirements for Requests for Proposals, the City will be providing those vendors with notification of your public records request. Each vendor will have five business days from the date of the letter to file suit in Polk County District Court for an injunction or a declaratory order to protect and keep the records confidential. Absent a court order declaring such information to remain confidential, the documents will be released to you at that time. If an order by the court is provided, a copy the order will be forwarded to you.

The City expects to have these notifications sent out to the vendors by the end of this week. Per the requirements, the City will allow each vendor five business days to respond or file a Petition with the District Court. If the court deems the records marked "confidential" to be proprietary information, redaction of the documents will be necessary. This will take staff time, and an estimate for fulfillment will be provided to you for a deposit payment before any such work will begin, as stated in the City's Cost Policy which was provided to you in a previous email.

I will be in touch with you once we know how each vendor plans to proceed.
