Any emails, letters, or any other records in written, electronic, or any other form, as defined by C.R.S. §§ 24-72-202(7) which were sent, received, or produced mentioning "costs" of "clean ups," "costs" for the services of the private contracted company "Environmental Hazmat Services," "inmate" labor used for "clean ups," "costs" to pay on duty "officers" for "clean ups," and/or "costs" for "storage" of items from "clean ups" during the time starting on October 1, 2018 until the date on which this request is processed. 

If you deny this request for records in whole or in part, I ask that you provide a written statement explaining the reason for the denial that cites the legal authority that is the basis for the denial. If any of the requested records are in active use, in storage or otherwise unavailable at this time, I likewise request that you provide a statement informing me of the reason they are currently unavailable and a date and hour at which time the records will be available for inspection.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Please accept this response on behalf of the Denver Police Department to your follow up records request dated July 27, 2019. You requested the following information from the Denver Police Department:

The Denver Police Department is not the custodian of record for the contracts between the City and County of Denver and Environmental Hazmat Services. Please contact the Denver Department of Public Health and Environment (“DDPHE”) for a copy of those contracts which contain a breakdown of the cost structure. Ann Cecchine-Williams (Ann.Cecchine-Williams@denvergov.org<mailto:Ann.Cecchine-Williams@denvergov.org>) is the Communications Director for DDPHE and she will be able to assist with this request.
Regarding your request for an email search. This request can be very costly given the amount of time it will take to search for, identify, review and redact the responsive emails. We have identified at least 10 individuals within the Denver Police Department that may have emails responsive to this request but we will not know until we begin this process. The cost of $33 per hour, will be charged for any research, retrieval, review and redaction of records we may identify as responsive to this request. Please advise if you are willing to incur these costs and what budget you have allotted for this project.

Thank you for your timely response. The request I sent the Denver Police Department does not only include an e-mail search. I am requesting any emails, letters, or any other records in written, electronic, or any other form, as defined by C.R.S. §§ 24-72-202(7) which were sent, received, or produced mentioning the "costs" of "clean ups," specifically the "costs" to pay on duty "officers" for "clean ups," and "inmate" labor used for "clean ups" during the time starting on October 1, 2018 until the date on which this request is processed.
However in accordance with C.R.S. §§ 24-72-205(4), if the only existing records are electronic, and therefore requiring computer output other than word processing, such as providing the electronic services and putting the records together, then I am further requesting that the fee be waived because the electronic services and products are to be used for a public purpose, since I am a journalist with a nonprofit media organization.

I just received the results of the query search and we have around 141 emails responsive to the search for “Environmental Hazmat Services” and “costs” and “clean up” and “costs to pay on duty officers”. I believe the review and redactions will take around 8-10 hours. This again is just an estimate and I will know more once I get halfway through the emails. Also, a project of this nature would require payment upfront. Please let me know if you would like to proceed and I can draft an invoice for your review.
