Pursuant to the Colorado Open Records Act, I hereby request the following records:

It has recently come to my attention that the Department of Transportation and Infrastructure (DOTI) keeps a calendar 6 weeks out of planned sweeps. It has also come to our attention that DOTI has a ranking system to rank encampments to sweep.

These are critical procedures affecting our community. They should not be kept secret but should be transparent government procedures for the public to be aware of and help inform the best procedures possible.

Send me the cleanup calendar and the encampment ranking procedures with the current encampments rank.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

How would you not have these documents when your department publicly stated that they exist?

Please set a date and hour, within three working days following receipt of this letter, at which time the records will be made available for inspection. If access to these records will take longer, please cite the extenuating circumstances and let me know when I should expect copies or the ability to inspect the requested records.

If you deny any portion, or all, of this request, please provide me with a written explanation of the reason(s) for your denial, including a citation to each specific statutory exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law. If it is not a 6 week schedule, please provide the rubric and any other document you use to post "clean up" notices? How does a camp end up getting posted? What is the process that DOTI/DDPHE, including but not limited to, DDPHE's encampment investiga4ioo team, use to identify, evaluate, and determine which sites for "clean up", "area restriction" or any other internal name you use for the sweeps. We are looking for the documents that lead up to the attached 7 day notice.

Hello David,

I apologize for the delayed response. DOTI is not the custodian of records used to identify, evaluate and determine cleanup schedules and would withhold from public disclosure any such records it received as deliberative and pre-decisional in nature, per the CORA deliberative process privilege.
