Pursuant to the Texas Public Information Act, I hereby request the following records:

I am requesting the audio and video footage from a bodycam worn by an Officer R. Brazell who was present during a court proceeding that was held on September 8. 2021 with the Defendant Eugene Irvin III between the hours of 12p - 2:45p in the 158th Judicial District Court of Denton County, Texas, Honorable Judge Steve Burgess presiding.

In addition, I would also like to receive the written transcript for the above court proceeding.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

On March 13, 2020, Governor Greg Abbott signed a proclamation certifying that COVID-19 poses an imminent threat of disaster in the state and declaring a state of disaster for all counties in Texas. Further, on March 18, 2020, Denton County Judge Andy Eads signed Executive Order AE-20-03-18, a Disaster Declaration delineating certain restrictions for the safety of both the general public and employees. The Denton County Sheriff’s Records Division will continue to fulfill all public information requests within the statutory time-frame; however, due to the pandemic and subsequent declarations, there may be days when the Division is operating with minimum staff to reduce the risk of infection. During such times, the DCSO’s Records Division will be utilizing Texas Government Code, Section 552.223 which expands the statutory response time.

We apologize for the inconvenience but DCSO Records Division had not received your request at the time of submission, dated October 3, 2022.

I’m not sure how you were able to submit this request, we had changed from the GovQA platform to the JustFOIA platform in January 2022. Therefore, Denton County Sheriff’s Office Records Division did not receive the initial request.
