Please accept this response to the FOIA request you sent to the Department of Correction on April 4, 2019 requesting "a complete and accurate count of all transgender inmates currently in custody in the Delaware Department of Corrections as mandated to be recorded by the Prison Rape Elimination Act including:

-the number of transgender women in custody
-the number of transgender women who are housed in men's facilities
-the number of transgender men in custody
-the number of transgender men who are housed in women's facilities
-the number of transgender people who are taking hormones"

In response to your request, as of March 28, 2019, the Delaware Department of Correction had twenty-four (24) offenders who had self-reported as transgender, completed the medical and behavioral health evaluations per DOC Policy 11-E-14, and were included on the active roster of offenders identifying as gender-nonconforming.

As of March 28, 2019, all offenders housed in DDOC female facilities were identified as biologically female at birth. Additionally, all offenders housed in DDOC male facilities were identified as biologically male at birth.

This fully responds to your FOIA request so this matter is now considered closed.

In response to your follow up inquiry, as of March 28, 2019, Delaware DOC had in custody fifteen (15) individuals who have identified themselves to the Department as transgender women and nine (9) who have identified themselves to the Department as transgender men.
