The Public Service Commission checked their databases for any complaints regarding inmate or prison calling services with no results. The Public Service Commission does not regulate these service contracts and rates. The contracts for rates and services for state owned facilities are handled by the Department of Technology and Information. You may also consider submitting your request to the Department of Correction in case they have additional information.

I am copying on this email the Department of Technology and Information, and the Department of Correction FOIA coordinators.

With this response, we now consider your request with the Public Service Commission closed.

Please provide the DOC with a time frame for your request, along with the specific search terms you are requesting the DOC’s information and technology personnel to use in conducting a records search. Once you have provided that information, the DOC will provide you with a cost estimate of the charges expected to be incurred in retrieving such records. See 11 Del. C. § 10003(i)(2). Please be aware that the DOC may require administrative fees for requests requiring more than 1 hour of staff time to process. 11 Del. C. § 10003(m)(2).

Please accept this acknowledgment and response to the request for information you sent to the Department of Correction on June 16, 2017 requesting all complaints regarding interstate and intrastate inmate calling services rates or service specifically materials from January 1, 2015 through the most recent reports including the procurement materials, the contract, and any associated invoices.
The Department of Correction denies your FOIA request for the complaints for the following reasons. First, 29 Del. C. § 10002(l)(6) excludes the records you have requested because they are specifically exempted from public disclosure by statute. 11 Del. C. § 4322(a) ("the supervision history and all other case records obtained in the discharge of official duty by any member or employee of the Department shall be privileged and shall not be disclosed directly or indirectly to anyone other than the courts as defined in § 4302 of this title, the Board of Parole, the Board of Pardons, the Attorney General and the Deputies Attorney General or others entitled by this chapter to receive such information")).

In response to your request for the contract and procurement materials, please find enclosed the executed Contract No. DTI15001-INMT-PBLC Inmate & Public Coin Telephone Services maintained and managed on behalf of the Delaware Department of Correction (DOC) by the Delaware Department of Technology & Information (DTI).
