To Whom It May Concern:

Pursuant to Delaware's Freedom of Information Act, I hereby request the following records:

Records used to determine if a Freedom of Information Act request can be denied because the records requested do not relate to the expenditure of public funds. Records satisfying this request may include, but are not limited to: budgets, memos, departmental guides, and policies.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Thank you for your email dated March 9, 2016.

Under the Delaware Freedom of Information Act, University documents are
public records only if they relate to the expenditure of public funds.
29 *Del.
C.*§10002(d). Public funds are "those funds derived from the State or any
political subdivision of the State." 29 *Del. C. *§10002(k). The records
you seek do not relate to the expenditure of public funds and, as a result,
are not public records. The University, therefore, respectfully declines
your records request.
