Dear Mr. Brown:
I write in response to the request you submitted to the University of
Delaware under Delaware's Freedom of Information Act on August 14,
2019. Pursuant
to Delaware's FOIA, only university records that relate to the expenditure
of public funds are public records subject to disclosure under the
Act. 29 *Del.
C. *§10002(i). Public funds are "those funds derived from the State or any
political subdivision of the State." *Id. *at §10002(k). The University's
athletic department is not supported with public funds. Therefore, as your
request does not relate to the expenditure of public funds, the University
has no responsive public records.
