Dear Mr. Lloyd:

This will respond to your New York State Freedom of Information
Law (“FOIL”) request received by me on February 7, 2022. I am responding
to your request as the Records Access Officer of the Duanesburg Central
School District. In your request you seek:

“Copies of oaths of offices for each of the current board members.”

“Copies of oaths of offices for the Superintendent and Treasurer”

Copies of or information regarding surety or public school system faithful
performance bonds and contact information for the bonding agent covering
the board members as required by Subdivision 2 of Section 11 of the Public
Officers Law and Subdivision 2(d) of Section 170 of the Commissioner’s
Regulations.”

Please be advised that your request is granted in part and
denied in part. With regard to that portion of your request which is
granted, the Duanesburg Central School District is in possession of records
that it believes are responsive to your request for copies of oaths of
offices for each of the current board members. Specifically, the District
is in possession of the most recent Board of Education Reorganization
Meeting from July 06, 2021, which sets forth the oath of office each
current board member took. An electronic copy of the minutes is available

With regard to that portion(s) of your request which is being
denied, the District does not have documents relating to “faithful
performance bonds . . . covering the board members as required by
Subdivision 2 of Section 11 of the Public Officers Law and Subdivision 2(d)
of Section 170 of the Commissioner's Regulations” because those laws and
regulations do not require such bonds. Therefore, that portion of your
request is denied.

To ensure the integrity of the District’s internet and network
we are unable to upload any documents to the referenced account. We will,
however, provide them by email, attached hereto, or you may request hard
copies upon the payment of $_____ (.25 cents/page x __ pages).

Any appeal of this decision should be made within thirty (30)
days, in writing to the Duanesburg Central School District. Duanesburg
