To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

I would like a copy of Theresa's autopsy and pathology reports from December 1978 and January 1979. A copy of the chain of custody report which documents her vaginal swabs were lost in a fire that became a flood

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

GERALDINE HOUDE

  • SPR18-468 Supplemental Request for Reconsideration of Appeal

From: GERALDINE HOUDE

Dear ADA McGee,
Thank you for your response. I would like to remind the NDAO that ADA Mohan asked to be present with the MSP crime lab, when the family arranged and paid for Theresa to be exhumed in May of 2017. As a family, we were grateful when the NDAO finally showed interest in seeing if any further forensic evidence could be obtained from her remains.
Since learning in 2015 Theresa's vaginal swabs were "lost in a fire that became a flood." The Corley family started to actively seek answers for ourselves. One of those activities was to push for the exhumation.

We only seek to see documentation of the crime lab fire, the date and circumstances in which her vaginal swabs were lost. We are not seeking to know the results of any testing at this point.

I was also told in 2015, I could have a copy of the autopsy report by Ms. Beland. In attempting to get it myself, as directed by Ms. Beland, I discovered the autopsy report would need to be obtained from the NDAO because the state started archiving only after 1983. Up to that point the autopsy report would have to come from the NDAO. After several weeks, I was informed in a letter from your office, that I could not have the autopsy report that I was told I could have.

I believe we are all trying to do right by my sister Theresa in bringing this case to a conclusion, however, I continue to not agree with the lack of transparency and strongly feel the need for a third party to be able to ascertain the documents requested are indeed in Theresa's case file.

Sincerely,

Geraldine Houde
