Pursuant to Alabama's Public Records Law, I hereby request the following records:
An inventory of all surveillance system components removed/inventoried on or around August 28, 2013 from the residence where Matthew Hoppenjans was taken into custody during a drug activity investigation at the 2000 block of Pennylane Street. The sheriff's office says the Decatur Police were the lead for this operation. If not already included, please include the brand, quantity, and model numbers of each item.
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

Mr. Purvis,
If this is evidence in a criminal investigation it probably will not be released until the evidence is released by the court. You will need to get his discovery through the DA's office. Our department does not have access to this information. Nor does the City have in their possession anything other than what might be in evidence in the PD.

I'll contact the DA's office, but I have to admit I'm a little confused by your response. Are you saying I need to go through the police department and not the city to get police records? Would the police not the have an inventory of evidence they collected?

Mr Purvis,
I submitted your request to Legal and I this was the response I got:
We are not going to release any information pertaining to this case as all information related to it is involved in a criminal investigation/prosecution. We are not authorized to release the information and are not inclined to release the information. Any requests for information should be made by Mr. Hoppenjans himself or by his attorney if he has one and those requests will be subject to the Alabama Rules of Criminal Procedure discovery rules and are not controlled by the public records request laws. The District Attorney will not respond to his requests because they can only deal with the defendant unless he is represented by an attorney and if he is, then the DA can only deal with the attorney and no one else.
Mr. Purvis cannot circumvent the Alabama Rules of Criminal Procedure by requesting things directly from us that he can only get through the District Attorney.
We will not be releasing this information or any other information about this case to him.
