Pursuant to the Connecticut Freedom of Information Act, I hereby request the following records:

All documents, electronic or written, in connection with Health inspections conducted that included hookah smoking at establishments in Danbury, CT in 2021 including any orders issued by the City of Danbury departments, inspection reports, memos, referral letters to state agencies, photos, and references to other Danbury city departments.

I also request that, if possible and pursuant to Conn. Gen. Stat. § 1-212(d), fees be waived as I believe this request is in the public interest and not made for commercial gain. The requested documents will be processed by a representative of the news media/press and made available to the public at MuckRock.com.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 4 business days, as the statute requires.

I have reviewed much of the responsive documents. I am confused as to what has been redacted that you refer to in previous correspondence. It is customary to mask redacted information in black (contrasting the document background). Can you please update the document with the customary black masking? Thank you for your help in this matter?

Kevin, I used white redacting tape. The redactions were made to one email
which contains the words "corporation counsel."

There is no requirement under the FOI Act that redaction be black.

Dianne, I am not objecting to the use of white opaque tape. However, it is not obvious to the casual reader viewing this document what has actually been redacted. This request is on a google searchable website and at the minimum, a black box showing what part of the document is not original and/or a description of the exemption number you are claiming would be the best practice in providing these documents.

I politely request the document be provided in a format that allows your redaction claim to be assessed. My objection would be satisfied with an outline of the area of the document that is being redacted. I am including some examples of my request.

Kevin, I disagree that there is any requirement to redact a document as you
indicate under the FOI Act, but in an effort to bring this matter to
conclusion, I have re-redacted the pages for the email in question. See
attached.

Please remit a check made payable to the City of Danbury in the amount of
$2.00 (4 pages x $.50- invoice attached) for such redacted pages to: City
of Danbury, Office of the Corporation Counsel, 155 Deer Hill Avenue,

2018-0293 (February 13, 2019) FN 2, *citing* *Kozlowski v. Freedom of
Information Commission*, superior court, docket number CV-960556965 (JD
Hartford-New Britain) July 29, 1997. " . . .[i]f a public agency receives
a request for a copy of, or to inspect, a record that contains information
that is required by law to be redacted, and the public agency must make a
copy of the record in order to redact such information, the public agency
may charge the requester the statutory fee for that copy."

As to your question about referrals to state agencies, the Health
Department confirmed that there are no other records.

Accordingly, the City considers this FOI request concluded.
