From: Gabrielle Mendler

To Whom It May Concern:

Pursuant to the Texas Public Information Act, I hereby request the following records:

I would like the non-certified autopsy report for Alan White, DOB 6/16/65, and DOD 10/22/20, if said information is public record and can be released to the public. Case number is 188623-2020. I understand that the Medical Examiner's Office, back in January 2021, was waiting for results from Southwestern Institute of Forensic Sciences. However, if any portion of the autopsy report can be publicly released in accordance with the Freedom of Information Act, I would appreciate it.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Gabrielle Mendler

Thank you so much for the response. In the above fax, you mention e-mail correspondence attached as Exhibit B; I have not received said e-mail or any specific note from the acting Detective. Could you please re-fax?

From: Dallas County Medical Examiner's Office

To whom it may concern,

You were not provided a copy of Ex. B to the brief as that was a communication between myself and the investigating law enforcement agency. If you look at the exhibits that are noted at the bottom of the brief, you were only provided with Exhibit A.

The Texas Attorney General was provided with all exhibits and will make a determination regarding your request soon.

Ms. Mendler, I am attaching the Texas Attorney General's ruling regarding the attached request you submitted in November of last year. My office never received a copy of the ruling until I looked online today. I am unsure if you ever received a copy so I am forwarding just in case.

Thank you.

Hello,
May I please verify that the release of this autopsy report/forensic testing results (of James Allen White) has still not entered the public record due to the case remaining open and the information contained in said report being exempted from public disclosure? Thank you!

Per Dallas Police Department, this investigation is still on-going and they do not want the records released at this time. Therefore, the ME is relying on previous AG ruling to withhold these records.
