Pursuant to the Ohio Open Records Law, I hereby request the following records:

Hello,

I am looking for the amount of time from submitting payment online to the process time for all traffic violations for the county of Cuyahoga in Ohio state for the whole month of March 2015.

If processing time took longer than the maximum amount of days to pay the traffic fine, I would like the number of warrants of arrest issued for the month of March 2015.

The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is not being made for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

Good morning Ms. Sladick,

I sent the response below April 17th, 2015. In the case of online payments, the transaction is recorded immediately. Sometimes online payments are made at the last minute-as the court personnel are setting up in the courtroom for a hearing. Still, a clerk checks the computer in the courtroom for last minute payments and capias orders are only given when no payment has been recorded. Are you asking for the number of all capias orders that were made for all traffic fines in the month of March 2015? If you are asking for the number of capiases (warrants) issued after an online payment was made before the payment deadline, the answer would be none.

Good morning,

I need some clarification. Your request is for traffic violations in Cuyahoga County. We only process violations in the City of Cleveland.

Tickets in Cleveland typically have a 2 week window for payment from the time of issuance until the court date that the officer writes on the ticket. If payment is not received, and the court date is missed, that’s when a capias (warrant) is issued, and a $30 late fee is added to the fine.

Sometimes after a warrant has been issued, payment is received by mail, and it’s clear that the payment was sent prior to the court date. In that case, the $30 late fee is canceled, and if it was paid, it is refunded.

Sometimes it takes tickets longer than 2 weeks to be entered into our computer system. In those rare cases, there is no capias(warrant) issued, and no late fee assessed, because the ticket was not entered into the computer system until after the court date that was written on the ticket.

I’m not sure how many of your questions I’ve answered. Given that information, I’m not sure what your request is.
