Pursuant to the California Public Records Act, I hereby request the following records:
In accordance with SB1421 I would like any of the following complaints or records of disciplinary action:
Investigative reports, Photographic, audio, and video evidence; transcripts or recording of interviews.
Materials compiled and presented for review to the district attorney or to any person or body charged with determining whether to file criminal charges against an officer in connection with an incident, or whether the officer’s action was consistent with law and agency policy for purposes of discipline or administrative action, or what discipline to impose or corrective action to take.
Documents setting forth finding or recommended findings.
Copies of disciplinary records relating to the incident, including any letters of intent to impose discipline, any documents reflecting modifications of discipline due to the Skelly or grievance process, and letters indicating final imposition of discipline or other documentation reflecting implementation of corrective action.
Please also include a report of training records and arrests and uses of force:

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Please clarify if you are requesting the list of complaints, records of disciplinary action, and report of training records relating to Officer Gooch or are you seeking complaints or records of disciplinary action for the department and only training records relating to Officer Gooch.

Re: Public Records Act Request PRR 21-108
Dear Mr. Wesson:
On April 26, 2021, the City of Covina ("City") received your request for public records. In accordance with Government Code Sections 6253(c) and 6255(b), this letter serves as the City's written response to your request. Your request seeks records of complaints or records of disciplinary action regarding Officer Thomas Gooch as follows:
* Investigative reports;
* Photographic, audio, and video evidence;
* Transcripts or recording of interviews;
* Materials compiled and presented for review to the District Attorney or to any person or body charged with determining whether to file criminal charges against an officer in connection with an incident, or whether the officer's action was consistent with law and agency policy for purposes of discipline or administrative action, or what discipline to impose or corrective action to take;
* Documents setting forth finding or recommended findings relating to disciplinary action;
* Copies of disciplinary records relating to the incident, including any letters of intent to impose discipline;
* Any documents reflecting modifications of discipline due to the Skelly or grievance process;
* Letters indicating final imposition of discipline or other documentation reflecting implementation of corrective action; and
* A report of training records and arrests and uses of force.
The City has conducted a thorough review of its files and has collected all documents responsive to your request that are not exempt from disclosure pursuant to the Public Records Act. Except as noted below, all disclosable documents responsive to your request are enclosed with this letter.
Please note that the Public Records Act permits a local agency to withhold from disclosure records that are exempt from disclosure (Cal. Gov't Code § 6250 et seq.). Therefore, to the extent certain documents are exempt from disclosure, the City will withhold certain records from disclosure, in whole or in part, pursuant to the following exemptions:
1. Records of complaints to, or investigations conducted by, a local policy agency, or any investigatory files compiled by a local agency for law enforcement purposes are exempt from disclosure pursuant to California Government Code Section 6254(f).
In addition, the City has no documents that are required to be disclosed under California Penal Code Section 832.7(b).

Question, Level II officers must complete 24 hours of CPT every 2 years per POST, correct?
It appears that this reserve officer is out of compliance. Can you confirm? what is the penalty or actions taken by your agency for someone out of compliance?
What is your department policy on CPT compliance?

Attached is the training policy for which Officer Gooch is in compliance with. There are currently no documents specifying a penalty for officers out of compliance as they are scheduled for training when found to be out of compliance.
