From: Brandon Smith

To Whom It May Concern:

Pursuant to the Illinois Freedom of Information Act (5 ILCS 140/1 to 11), I hereby request the following records:

All communications to or from or within the States Attorneys Office (SAO) relating to the office's decision on *whether to* charge former Chicago Police Officer Dante Servin in the death of Rekia Boyd. Also: all communications to/from/within the SAO regarding *what* charge to issue or file against Mister Servin. This includes all communications as to the effectiveness, appropriateness, or lawfulness of any particular charge and its likelihood of being struck down in court. For these purposes, "communications" may include but is not limited to e-mails, memos, paper letters, notes in paper or digital case files, posts on any internal chat or collaborative server or networked computer tool, voice recordings, voice mails, or any other retained discussion. Responsive documents do not have to include full investigation files, but they do have to include any part of an investigation file if that part includes a comment relating to possible charges against Mr. Servin.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, ideally by e-mail attachment or by CD-ROM if email is not feasible.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Sincerely,

Brandon Smith

From: PAUL CASTIGLIONE (States Attorney)

Mr. Brandon Smith,

I have received your FOIA request of 7/22/16. I have been out of the office for about a week and, in fact, have just returned today. I will need to reach out to different people in my office to conduct the appropriate searches and to figure out what responsive documents, if any, that we have. This process will take a little bit of time. As a result, pursuant to Section 3(e) of FOIA, I request an extension of time of 14 days on or before August 11, 2016 to respond to your FOIA request.

If this poses a problem, please let me know. Thank you.
