Pursuant to the Connecticut Freedom of Information Act ("FOIA"), I hereby request the following records:

Copy of the January 2009 letter from Chief Justice Chase T. Rogers containing the quoted phrase, “Not only does this implicate statutory issues but also union contract rights” referred to on page 10 of the 2009 Final Report of the Connecticut Judiciary-Media Committee Subcommittee on Audio Recording of Court Proceedings.

I also request that, if possible and pursuant to Conn. Gen. Stat. § 1-212(d), fees be waived as I believe this request is in the public interest and not made for commercial gain. The requested documents will be processed by a representative of the news media/press and made available to the public at MuckRock.com.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 4 business days, as the statute requires.

Your recent request for a copy of Chief Justice Rogers' letter to referred to on page 10 of the 2009 Final Report of the Connecticut Judiciary-Media Committee Subcommittee on Audio Recording of Court Proceedings has been forwarded to me for a reply.

A copy of Chief Justice Rogers' letter is attached as Exhibit 10 to the 2009 Final Report that you referenced, however, the letter does not include the quoted language. (The report appears at http://www.jud.ct.gov/Committees/media/audio/FinalReport09.pdf and Exhibit 10 can be found at pages 67 - 68.) I am in the process of determining if I can obtain a copy of an attachment referenced in Chief Justice Rogers' letter, which was not included as part of the exhibit, to see if possibly that contains the language that you quoted.
