To Whom It May Concern:

Pursuant to the New Hampshire Right to Know Law, I hereby request the following records:

Definitions for this request:

1. Relevant Period: “Relevant Period” means January 1, 2015 to April 10, 2019.
2. Record: “Record” means any Writing containing information related to the conduct of the public’s business prepared, owned, used, or retained by NHDOT regardless of physical form or characteristics.
3. Writing: “Writing” means any handwriting, typewriting, printing, photostating, photographing, photocopying, transmitting by electronic mail or facsimile, and recording by every other means. This Writing could be manifested in various forms of communication or representation, including letters, words, pictures, sounds, symbols, or combinations of any of these preceding representations. In this, I am requesting any record thereby created, regardless of the manner in which the record has been stored.
4. IMMS: “IMMS” means any information management system or similar system for storing and/or locating Records used by NHDOT during the Relevant Period.
5. AAH Program: “AAH Program” means the Adopt-A-Highway Program administered by NHDOT.
6. Adoption: “Adoption” means the taking of responsibility for litter removal on a portion of the Highway pursuant to the AAH Program by any person, organization, or entity other than NHDOT.
7. Volunteer Adoption: A “Volunteer Adoption” means the Adoption of a portion of the Highway by a person or organization or an entity that performs litter removal without contracting with a third party.
8. Sponsored Adoption: A “Sponsored Adoption” means the Adoption of a portion of the Highway by a person, organization, or entity that contracts with a third party, approved by NHDOT, to perform litter removal on behalf of the Adopter.
9. Adopter: “Adopter” means a person, organization, or entity that has adopted a portion of the Highway pursuant to a Volunteer Adoption.
10. Sponsor: “Sponsor” means a person, organization, or entity that had adopted a portion of the Highway pursuant to a Sponsored Adoption.
11. Contractor: “Contractor” means any person, organization, or entity that has contracted with a Sponsor to perform litter removal on any portion of the Highway pursuant to a Sponsored Adoption.
12. Highway: “Highway” means all highways in the state of New Hampshire.

Records Request:

1. All Records that identify any Adopter or Sponsor of any portion of the Highway at any time during the Relevant Period.
2. For each Adopter or Sponsor identified in response to Request 1 above, all Records that show:
a. The portion of the Highway (county, beginning post mile, ending post mile, direction) adopted.
b. The time period of the Adoption.
c. Whether the Adoption is a Volunteer Adoption or a Sponsored Adoption.
d. What frequency of litter removal is or was required by NHDOT for the adopted portion of the Highway.
e. If the adoption is a Sponsored Adoption, the name and address of the Contractor.
3. For each Adopter, Sponsor, or Contractor identified in response to Requests 1 and 2 above, all Records that show:
a. The dates (day and/or month) on which the Adopter, Sponsor, or Contractor performed litter removal services on the Highway.
b. The amount of litter collected.
c. The dates (day and/or month) on which NHDOT removed from the Highway any bags of litter collected by the Adopter, Sponsor, or Contractor.
d. The amount of litter collected by NHDOT.
4. For any portion of the Highway that was not adopted any time during the Relevant Period, all Records that show:
a. The dates (day and/or month) on which the Adopter, Sponsor, or Contractor performed litter removal services on the Highway.
b. The amount of litter removed.
c. The dates (day and/or month) on which NHDOT removed from the Highway any bags of litter collected by the Adopter, Sponsor, or Contractor.
d. The amount of litter collected by NHDOT.
e. What frequency of litter removal is or was required by NHDOT for each unadopted portion of the Highway.
5. All Work Events Summaries referencing activities during the Relevant Period on the Highway.
6. All Reporting Forms referencing activities during the Relevant Period on the Highway.

With respect to information maintained in IMMS, I request this information in an aggregated electronic format (spreadsheet or database), if this is its native format. If information is provided by PDF, I request the information be in a clean, machine-readable format.

If any materials responsive to these Requests contain material explicitly exempted from disclosure, I request you redact it and provide the remaining material.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Ms. Brassil,

The NH DOT has received your FOIA / Right to Know request for information related to the New Hampshire's Adopt a Highway program.

Pursuant to NH RSA 91-A, this letter serves as the acknowledgement to your request.

Based on our initial review the NH DOT believes that it will take approximately 7 days from the date of this email to accurately estimate the time and potential cost for all the documents you have requested.

Note that we do not have an existing document or a central database summarizes this information. In order to satisfy your request in a timely manner I would like to speak with you, at your earliest convenience, about the documents that do exist.

In accordance with the NH's Right to Know Law (RSA 91-A:4), the Department is permitted to charge reasonable costs for copying the material. The current charge for black & white copies is $0.10 per 8.5x11 page, and $0.20 per 11x17 page. Once the NH DOT has determined the costs for copies I will contact you before proceeding. Electronic documents will be provided at no cost if the documents exist in an electronic format.
