An interim response, stating the request is being processed.
From: Luke Stoddard Nathan
To Whom It May Concern:
Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:
- any and all records that reflect or memorialize the decision, or any justifications or reasons for said decision, by Columbia County District Attorney Paul Czajka, named special prosecutor by state Supreme Court Justice Richard M. Koweek, to not submit a potential criminal case against Ronald Foundation, Gary Gordon, or Shane Hug to a Grand Jury. This may include but not be limited to any intra-agency memoranda, worksheets or standard forms, and the letter sent by Czajka to defense attorneys on or around Oct. 5, 2017 described in the following Albany Times Union news article: <http://www.timesunion.com/news/article/Special-prosecutor-ends-Troy-911-case-12257927.php>.
If my request is too broad or does not adequately describe the Records, please contact me so that I may clarify my request, and when appropriate inform me of the manner in which Records are filed, retrieved or generated.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.
Sincerely,
Luke Stoddard Nathan

Mr. Carlucci,
I have received your acknowledgment letter of Oct. 16 re: my FOIL request concerning the Troy 911 case.
I write to advise you of a minor error in the language of my initial request: the name "Ronald Foundation" should instead be "Ronald Fountain."
I apologize for this mistake, and thank you in advance for making this adjustment for the purposes of processing this FOIL request.
Thank you.
