Pursuant to the Colorado Open Records Act, I hereby request the following records:

* Files, including letters, memos and emails, describing or discussing policies, guidance and procedures for providing COVID-19 vaccines to prisoners/inmates and/or staff.

* Files mentioning or describing the number of vaccines given to prisoners/inmates and/or staff.

I am a member of the news media and request classification as such. I have previously written about the government and its activities, with some reaching over 100,000 readers in outlets such as Gizmodo, MuckRock, Motherboard, Property of the People, Unicorn Riot, and The Outline, among others. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established. In addition, I discuss and comment on the files online and make them available through non-profits such as the library Internet Archive and the journalist non-profit MuckRock, disseminating them to a large audience. While my research is not limited to this, a great deal of it, including this, focuses on the activities and attitudes of the government itself.

As my primary purpose is to inform about government activities by reporting on it and making the raw data available, I request that fees be waived.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The Colorado Department of Corrections is a criminal justice agency and, as such, requests will be reviewed and responded to in accordance with the Colorado Criminal Justice Records Act (C.R.S. 24-72-301 et.seq.)
Requests received by the Records Custodian after 3 pm or any day that the Department of Corrections is officially closed will be considered received as of the next business day. Responses are typically provided within 7 business days of receipt (excluding weekends, holidays). If you have not received your response within 7 business days of receipt, please re-send your request so we can provide a status update.
If the request is for medical records; the response time is 30 days once a signed HIPAA compliant release of information consent, and any other required documentation, has been received by the medical records technician or designee at the appropriate facility.
Please note: The Department of Corrections may charge an hourly fee for the research, retrieval and preparation of records. The first hour of research, retrieval and preparation are without charge. Beyond the first hour, the fees may vary depending on the type of record and the discretion of the custodian but will not exceed $30 per hour. You will be advised in advance if your request will incur a fee.
In addition to the research, retrieval and production fees, there is a .25 per page fee for paper copies. The per page fee is not charged for electronic documents, however, research, retrieval and production fees still apply. Any fees due are payable in advance. Responsive documents will not be produced until payment has been tendered.
Fees may be waived by the Department on recommendation of the records custodian.
