Pursuant to Florida's Sunshine Law (Fla. Stat. secs. 119.01 to 119.15 (1995)), I hereby request the following records:

Seeking a certified copy of the Collier County Court public record which is the policy explaining the meaning of this email disclaimer attached to the Court's community outreach clerk's email (this appeared on the email he sent to my mom, which my mom showed to me):

"This electronic communication is confidential and may contain privileged information intended solely for the named addressee(s). It may not be used or disclosed except for the purpose for which it has been sent. If you are not the intended recipient, you must not copy, distribute or take any action induced by or in reliance on information contained in this message.

Unless expressly stated, opinions in this message are those of the individual sender and not of the Office of the Clerk of the Circuit Court of Collier County."

I seek this certified copy of the public record which is this court policy, because I can not understand for the life of me how information provided by the person employed as the "community outreach clerk" could be considered confidential, nor understand why anything anyone employed by the court says to the public is considered the "opinion" of that person and not a fact of the procedures of the court.

Hard to believe there is no explanation why such an email disclaimer even exists when the public is communicating with public employees on a public record. It seems like the disclaimer the court uses (below) is stating that email from court employees to the public is not a public record, when in fact it is.

Court's email disclaimer (below) to the public, on emails to the public from the court employees -- which are in fact public records:

"This transmittal and/or attachments may be a confidential attorney-client communication or may otherwise be privileged or confidential. If you are not the intended recipient, you are hereby notified that you have received this transmittal in error; any review, dissemination, distribution or copying of this transmittal is strictly prohibited. Again, it makes no sense why sometimes public record email from some court public employees will state the message "may be "privileged or confidential."
