If the state is not prosecuting for the DUI we would receive a Notice of Nolle Prosequi – this will not have the judge’s signature. If the Notice of Nolle Prosequi happens in open court it would be reflected on the court docket-in this situation sometimes we receive the formal Notice of Nolle Prosequi which we would then give that to the defendant or if the formal Notice is not filed, then they we would receive a certified copy of the court docket. If the charge is dismissed, we would either have an order dismissing the charge or a judgment & sentence with dismissed on it (these would be signed by the judge).

OK. That is all very helpful to know. I appreciate you explaining all that.

Now:

(1) Would the "Notice of Nolle Prosequi" include a signature from someone from the state attorney's office? Yes, it would have the State Attorney’s signature

(2) What exactly do you mean by the term "court docket" - is this a folder with papers in it, a computerized screen, or both? A court docket is a list of cases for that date, time and court proceeding. It has the defendant’s name, case #, charge etc and shows what happened to the case (ie continued, pled)

(3) Would a court computer screen show the status of a case as "nolle proseui in open court" - ? Yes it would

(4) If a charge is "dismissed' -- then the court would provide some type of document with a judge's signature. Is that document with a judge's signature provided to the attorney for the defendent? If we have an order, yes it would have the judge’s signature and a copy would be provided to the attorney

Florida Statute §119.07(1)(b) states “A custodian of public records or a person having custody of public records may designate another officer or employee of the agency to permit the inspection and copying of public records, but must disclose the identity of the designee to the person requesting to inspect or copy public records.” I am the designated employee of the Clerk of Court permitting the inspection and copying of public records. Therefore, I will be handling your public records requests addressed to this particular office.

What is a public record?
The Florida Supreme Court has determined that public records are all materials made or received by an agency in connection with official business which are used to perpetuate, communicate or formalize knowledge. They are not limited to traditional written documents. Tapes, photographs, films and sound recordings are also considered public records subject to inspection unless a statutory exemption exists.

Note this is also a request for a CERTIFIED public record. FL statute allows a member of the public to request either a copy --
or a "certified" copy of a public record.

You have altered the request and omitted the certifying part, and substituted an "attestation" -- but an "attestation" is not allowed on a public record, according to the American Society of Notaries:

With regards to your request that I handwrite anything on the back of a check; the checks you will receive come from MuckRock News (not from me).

Finally, with respect to your mention of “easy tracking” I would suggest you send each batch of certified public records (if you have any in response to each request) in a separate envelope, and write a separate invoice for each batch, and include the cost of postage in your invoice, as I believe FL law allows you to include postage costs.

I hope this answers all your questions once and for all.

Since you continue to have difficulty filling these public record requests, I also suggest the following:

1) Print out the initial email you received from MuckRock News on each request;

2) Provide that email and the certified public records to Dr. Kamela Patton;

3) Let Dr. Patton, the superintendent, create an invoice for each batch; and

4) Allow Dr. Patton to correctly address each envelope.

I have cc-ed Dr. Patton on this email with the aformentioned polite suggestion that she do your job.

As this is not the first email you have sent which seems to me to have no legitimate purpose other than to harass me and to evade and delay sending public records, please stop emailing.

Again, I politely suggest: Go to your school district superintendent, Dr. Kamela Patton, and allow her to do your job of filling public record requests, since you have been unwilling, unable or prevented by others such as a school district attorney, perhaps, from doing your job for many years now.

I believe Dr. Patton does want the school district to be transparent, but apparently, my previous email to her and her speaking with you left you as confused as ever as to how to fill a public records request.

I hope she will help you by starting to do your job for you – or by hiring someone who is either willing or able to do the job of filling public record requests. Or, is not prevented from doing so by someone such as the school district attorney.

If the state is not prosecuting for the DUI we would receive a Notice of Nolle Prosequi – this will not have the judge’s signature. If the Notice of Nolle Prosequi happens in open court it would be reflected on the court docket-in this situation sometimes we receive the formal Notice of Nolle Prosequi which we would then give that to the defendant or if the formal Notice is not filed, then they we would receive a certified copy of the court docket. If the charge is dismissed, we would either have an order dismissing the charge or a judgment & sentence with dismissed on it (these would be signed by the judge).

OK. That is all very helpful to know. I appreciate you explaining all that.

Now:

(1) Would the "Notice of Nolle Prosequi" include a signature from someone from the state attorney's office? Yes, it would have the State Attorney’s signature

(2) What exactly do you mean by the term "court docket" - is this a folder with papers in it, a computerized screen, or both? A court docket is a list of cases for that date, time and court proceeding. It has the defendant’s name, case #, charge etc and shows what happened to the case (ie continued, pled)

(3) Would a court computer screen show the status of a case as "nolle proseui in open court" - ? Yes it would

(4) If a charge is "dismissed' -- then the court would provide some type of document with a judge's signature. Is that document with a judge's signature provided to the attorney for the defendent? If we have an order, yes it would have the judge’s signature and a copy would be provided to the attorney

I notice the Collier County Court site does not mention public records anywhere except at the very end of a 2-page FAQs section, where Court Clerk Dwight Brock's "policy" is posted as a pdf file -- wherein he claims the department heads under him have a duty to ensure public records "must be examined for accuracy, completeness..."

He also states in his "policy" on page 2 under "Public Record Defined" that public records include: "electronic mail...including email...."

Consequently, I don't know why you had such a difficult time understanding that the email requested here is a public record -- and why you, a lawyer, made such an effort to re-define it as something else (your statement on this public URL on MuckRock is as follows: "The original of the electronic email is not a document per se but is data stored in a database. ...").

Is it possible to view or get copies of public/official records by making a public records request
Yes. It is the policy of the state of Florida that all state, county, and municipal records are open for personal inspection and copying by any person. Providing access to public records is a duty of each agency in accordance with Florida Statute 119. Public records requests apply to all court records as provided in the court rule 2.420 Public Access to Judicial Branch Records. Also, Florida Statute FS 286.011 governs public access to public meetings.
