Pursuant to Pennsylvania Right to Know Act, I hereby request the following records:

A Shapefile or CSV containing at minimum the Address Points (house # and street name) and their corresponding Latitude/Longitude. If additional data such as the Unit Number, City, Zipcode, Parcel Id exists they should be included as well.

If this cannot be accessed, the parcel file including situs address would suffice.

Other names for this include: E911 Address Database, Civic Address File, Parcel Dataset, Land Ownership Dataset, Tax Parcels, Address Points.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

I have received a response back from our GIS Dept. in regards to your request.
They charge a flat fee of $500.00 for the information that you are requesting. That fee will not be waived.
Also if you purchase the information, you must sign an agreement not to re-sell the data or use it for commercial use.
They would like to know also how the data will be available to the public.

Please let me know via email if you want to move forward.
Your check or money order must be received before the data will be transferred.

Since I am making this request under the Pennsylvania's Right to Know Law I am obtaining a public record and as such any data received would not require a contractual agreement to be signed.
The act makes no provisions for requiring contractual agreements on requested data.

In addition public records obtained through the act do not have limitations on reselling or commercial use. I intend to publish this data via the OpenAddresses Publication where it will be accessible to anyone.

Since I do intend to publish this data via the OpenAddresses Publication I would request that the quote per Pennsylvania's new Right to Know Law Act 3 of 2008 Ch 13 Sec. 1307 Fee Limitations 4ii to include only the cost of duplication. In addition if the fee is over $50 could you provide a breakdown of how the fee will be spent on duplication.

Dear Mr. Ingalls,

After receiving your second email, I spoke again to the GIS Office.
The conclusion to the matter is as follows.

The information that you requested is not something that is available as requested by the County.
To the contrary, in order to comply with your request, the County would have to manipulate the data and format it
to comply with your request. pursuant to Section 705 of the Right to Know Law, the County is not required to "create a record which does not
currently exist or to compile, maintain, format or organize a record in a manner in which the agency does not currently compile, maintain, format
or organize the record." Accordingly, your request is denied.

However, the County is willing to compile the data and provide it to you in the format requested in accordance with the attached fee schedule.
As indicated in our prior email, the County's fee for your request is $500.00 due to work involved. Again, it would be provided in accordance
with your agreement that the information is not being re-sold or used commercially.
Please let me know if you would like to move forward. As previously indicated, payment must be received in advance.

$500 seems excessive for compiling a records. Most counties have charged $25 to $50 for an employee to export to a shapefile from ArcGIS.

Pursuant to Pennsylvania Right to Know Act if I do not receive a response within 5 business days I will have no choice but to appeal with the Office of Open Records.

The current data is derived from our CAD system which contains confidential information. Also, there are no field aliases which we add on when we receive a request
As per the request if address points do not exist for the county I am happy to accept a parcel shapefile that has the Situs address our parcels shapefile does not contain any information but the parcel number . I can do my own ST_PointOnSurface calculation.
