At this time I am unable to complete your request. You have made a request under the Virginia Freedom of Information Act which applies to Virginia residents or those media outlets that fill subscriptions with in the Commonwealth of Virginia. I note that you advise the information would be made available to the public and I suspect that you are involved with some form of news outlet but cannot confirm at this point. If you can provide information that would verify that you are a news outlet and do service the Virginia area, this would be of help.

If you cannot do so, the 5 business day turn-around would not apply and filling your request would be out of courtesy. In addition there will be a charge related to public release information as is the policy of the agency. I can advise you of that cost once the information is gathered and processing charges determined. I will gladly advise you of the cost once it has been identified.

Other than the fore mentioned, the only other clarification would be that of the "records I am requesting include but are not limited to incident reports and discharge round reports". Are you requesting all available records on the incident or the incident based report only? The agency does not complete a second or separate report for round discharge.

Please be advised that under Virginia Freedom of Virginia laws, I am in the process of filling your request, however the request is significant as the case file is large. VA FOIA allows seven additional work days when such request is significant and we do not feel that we can have the request completed within the five work day time limit. I will continue to work on your request and may not need the total number of seven additional days.

You do mention that MuckRock is handling your request. However, this request will be too large to send by way of the electronic means. You may select to have the materials mailed to you or have them scanned and placed on disc and mailed to you. There will be a charge associated with the process of this request. The significance in the cost of scanning the numerous documents and placing them on disc will require a charge for the time to do so. Once completed I will notify you of the cost associated to your request both if copies are mailed and if placed on disc and mailed. You can determine at that time how you want to receive the documentation. I will notify you if the request is more than $200.00 which would require payment prior to delivering the materials.

I have an additional request from another subject utilizing MuckRock by another name. At this point we are trying to determine if this is one request or two separate request. I have the request available. If you choose to have copies mailed to you, the charge will be $56.13. if you choose to have the copies supplied to you via compact disc, the charge will be $70.96. I will need a Virginia mailing address to send the information as well as the invoice.
