Pursuant to the Illinois Freedom of Information Act., I hereby request the following records:

The following records for all City of Chicago employees and contractors. Please provide records for all current and ex employees to the extent of the retention and system capabilities of the relevant HR system(s).

The records responsive to this request are invaluable for understanding the underlying structure of the City of Chicago and its internal operation. As a result, the public's interest for this information far outweighs any burden and associated costs.

To ease many time burdens associated with this request, all possible technical escalation routes should be used.

As a reminder, it is the burden on the public body to make clear and convincing evidence that these records would be exempt, as described in (5 ILCS 140/1.2).

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hi - could you please explain further how it is that your agency does not maintain records that include a list of direct reports? Because you're providing a list of all employees, is there any way that I could instead be provided a list of each employee's manager? That would effectively provide the same information.

Dear Mr. Chapman,

Please note that the Freedom of Information Act (“FOIA”) requires a public body, such as the Department of Human Resources to produce documents. See 5 ILCS 140/3(a) (“Each public body shall make available to any person for inspection or copying all public records, except as otherwise provided in section 7 of this Act.”). FOIA does not require the public body to provide answers to questions or create documents. In Kenyon v. Garrels, 184 Ill. App. 3d 28, 32 (4th Dist. 1989), the Illinois Appellate Court noted that FOIA “….is not designed to compel the compilation of data the governmental body does not ordinarily keep. The Act does not compel the agency to provide answers to questions posed by the inquirer.”

As a courtesy to you, I will try to clarify our previous response. The database system we use that contains the information regarding all former and current City employees does not track managers/supervisors or direct reports of the individual employee. As such, the Department of Human Resources ("DHR") does not have the information you were seeking. The DHR does not have records of who each employee's manager is at a given time.
