Materials related to and sufficient to show all instances of alleged or actual inappropriate or illegal behavior or actions resulting in compensation or expenditures involving this agency.

Responsive materials include records of all settlements (formal and informal) and payments to which this agency was or is a party for the period from January 1, 2010 through the date this request is processed. Responsive materials include those for matters and legal claims resolved prior to the initiation of any litigation.

In particular, materials responsive to this request include all reports, lists, databases, spreadsheets, and other documentation detailing incidents of legal claims or other allegations requiring compensation for claimants, attorneys, or any other party.

If spreadsheets or similar documents are available in response to this request, please provide all segregable data, including but not limited to:

The nature of the claim or legal matter
The claimant and other parties involved
The relevant case and tracking numbers for court and internal systems
The date the lawsuit was served or litigation commenced
The final disposition or current status of the case, including whether a case is still pending
The amount spent to date as a result of the legal engagement
The amount paid to any parties related to the legal claim, including any city payout and any non-monetary compensation

The Law Department maintains most of the data you requested online at https://www.chicago.gov/city/en/depts/dol.html. The responsive records are under the heading titled “Judgment and Settlement Payment Requests.” Under Section 8.5(a) of FOIA “a public body is not required to copy a public record that is published on the public body’s website.”

The Law Department does not possess a document containing all the data you request. The only way to compile all of the requested information would be to create a document. While the FOIA requires a public body to produce documents (5 ILCS 140/3(a) (“Each public body shall make available to any person for inspection or copying all public records, except as otherwise provided in section 7 of this Act.”), the FOIA does not require a public body to provide answers to questions or create documents. In Kenyon v. Garrels, 184 Ill. App. 3d 28, 32 (4th Dist. 1989), the Illinois Appellate Court noted, “…the Act is not designed to compel the compilation of data the governmental body does not ordinarily keep.” See also: Chicago Tribune Company v. The Department of Financial and Professional Regulation, 2014 IL App (4th) 13042, ¶ 34. This position is included in the plain language of Section 1 of the FOIA: “This Act is not intended to create an obligation on the part of any public body to maintain or prepare any public record which was not maintained or prepared by such public body at the time when this Act becomes effective, except as otherwise required by applicable local, State or federal law.” 5 ILCS 140/1.

You have the right to have a denial reviewed by the Public Access Counselor (PAC) at the Office of the Illinois Attorney General, 500 S. 2nd Street, Springfield, Illinois 62706, (877) 299-3642. You also have the right to seek judicial review of your denial by filing a lawsuit in Cook County Circuit Court.
