Pursuant to the Illinois Freedom of Information Act., I hereby request the following records:
The following documents pertaining to the use of the gunshot detection system Shotspotter:
All event queries sufficient to show detections made by any Shotspotter device within any events from January 1st, 2020 to December 31st, 2020.
All responsive event queries should include the location of the event and location of the Shotspotter device triggered responsive to the incident. Responsive documents are requested to be in machine-readable format, ideally an Excel spreadsheet.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
As these records will be shared with the general public and local media organizations, the burden incurred by this request should be treated as inconsequential in contrast to the public's interest. Additionally, please be mindful that the burden to provide clear and convincing evidence of a exemption rests on the public body.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

On behalf of the Office of Emergency Management and Communications (OEMC), I am responding to your Freedom of Information (FOIA) request that our office received on February 22, 2021, wherein you requested the following information:

Pursuant to the Illinois Freedom of Information Act., I hereby request the following records:
The following documents pertaining to the use of the gunshot detection system Shotspotter:
All Shotspotter audio recordings retained from January 1st, 2020 to December 31st, 2020.
All responsive audio recordings should be in their unedited (or "raw") original format."
With respect to your request for audio recordings from January 2020 to December 2020, be advised, audio recordings are retained for only 90 days; therefore, the majority of the audio recordings you seek are no longer retained in our system, having been purged, prior to receipt of your request. That being said, records from December of 2020 may still be available; however, due to the large amount of Shot Spotter notifications received at the OEMC for the month of December, in the year 2020, this portion of your request is considered unduly burdensome and is therefore denied. With respect to your request, please be advised that your submission is considered unduly burdensome and is therefore being denied. Your request seeks radio zone communications regarding Shot Spotter notifications for the month of December 2020. Please note, the OEMC located 3,282 Shot Spotter notifications for the month of December in 2020. The FOIA provides in 5 ILCS 140/3(g) that requests for all records falling within a category shall be complied with unless compliance with the request would be unduly burdensome for the complying public body and there is no way to narrow the request and the burden on the public body outweighs the public interest in the information. For “radio transmissions” to be provided to you, each notification of the 3,282 notifications recovered must be individually searched, downloaded, redacted and reviewed before release. On average, an audio segment can play for less than 3-5 minutes before a new event/911 call is dispatched over the air; therefore, after every 3-5 minutes of zone radio play-back, redactions may be necessary. Please be advised, radio zone transmissions cannot be provided to you without first listening for and redacting information that is considered private and exempt under the FOIA. Other calls for police service are dispatched simultaneously on each radio zone; therefore, other incidents, unrelated to your request, must be redacted as well. As you may already know, caller identity, phone numbers, addresses, driver’s license numbers, license plate numbers, patient information of injured parties and other identifying information are all prohibited from dissemination under the Act. For radio zone transmissions to be released to the public, an audio retrieval team member must be assigned to this one request, away form from their normal duties. Once assigned, the audio researcher must listen to the audio in small increments for information that is exempt from disclosure. Listening in increments includes playing a segment of audio, listening for information that needs to be redacted, and reviewing the edited audio to ensure the necessary redactions were implemented. Once the first few steps are complete, the audio is reviewed once more to confirm the accuracy of the revisions. It is estimated that each recovered segment may have a playback span of 3-5 minutes. Once recovered, the audio must be edited to implement the necessary redactions. Due to the large amount of audio records requested for this inquiry, it has been concluded that approximately 273 hours (3,282 notifications at 5 minute intervals) are needed to complete this request. If you still seek records in response to this request, it is necessary that your FOIA submission seeking "Audio for Shot Spotter notifications" be narrowed and clarified. If you would like assistance in narrowing your request, please contact us, and we will assist you. Otherwise, as explained above, as your FOIA request is currently drafted, the OEMC is unable to respond to the request. If you agree to narrow your request, you must submit a revised written request. The OEMC will take no further action or send you any further correspondence unless and until your current request is narrowed in writing. If we do not receive your narrowed request within fourteen (14) calendar days of the date of this letter, your current request will be denied. In the event that we do not receive a narrowed request and your current FOIA request is therefore denied, you have a right of review by the Illinois Attorney General's Public Access Counselor who can be contacted at 500 S.
