Be advised, however, the portion of your request seeking each Event Query listed in the attached Standard Location Report is considered unduly burdensome and is therefore being denied. The FOIA provides in 5 ILCS 140/3(g) that requests for all records falling within a category shall be complied with unless compliance with the request would be unduly burdensome for the complying public body and there is no way to narrow the request and the burden on the public body outweighs the public interest in the information. On average, it takes 2-5 minutes to redact one page of  records.  Some event queries may yield only one document whereas others can exceed 10 or more. In order for Event Queries to be provided to you, each event query must be individually researched, reviewed and redacted to be released under FOIA.  This Report generated 678 Event Queries, based on the 2 minute review and redaction calculation, it estimated to take 22 hours to complete and provide redacted Event Queries in response to this request. Keep in mind, this estimate is based on each Event Query yeilding only (1) page; however, Event Queries are often more than one page. This would be an immeasurable burden upon the OEMC to produce. As stated above, each document must be reviewed and redacted for items exempt under FOIA. As you may already know, caller identity, phone numbers, addresses, driver’s license numbers, license plate numbers, patient information of injured parties and other unique identifiers, if released, would be considered an “unwarranted invasion of privacy” and are all exempt pursuant to 5 ILCS 140/7(1)(d)(iv), 7(1)(b) and 7(1)(c). Therefore, the dedication of staff and/or resources needed to review and redact 678 Event Queries is unduly burdensome on the daily operations of the Office of Emergency Management and Communications and is therefore denied. If you still seek records in response to this request, it is necessary that your FOIA submission seeking event queries be narrowed and clarified.  If you would like assistance in narrowing your request, please contact us, and we will assist you.  Otherwise, as explained above, as your FOIA request is currently drafted, the OEMC is unable to respond to the request. If you agree to narrow your request, you must submit a revised written request.  The OEMC will take no further action or send you any further correspondence unless and until your current request is narrowed in writing.  If we do not receive your narrowed request within fourteen (14) calendar days of the date of this letter, your current request will be denied. In the event that we do not receive a narrowed request and your current FOIA request is therefore denied, you have a right of review by the Illinois Attorney General's Public Access Counselor who can be contacted at 500 S. Second St., Springfield, IL 62706 or by telephone at (877)-299-FOIA. You may also seek judicial review of a denial under 5 ILCS 140/11 of FOIA. Sincerely,
