Pursuant to the Illinois Freedom of Information Act., I hereby request the following records:

All documents pertaining to the Chicago Metra's contract with ELERTS Corporation (https://elerts.com/). These documents might include, but are not limited to, the following:

- Initial Bid Documents
- Current and previous contracts with Motorola regarding ELERTS
- Requests for Proposals
- Memorandum(s) of Understanding
- Any privacy impact assessments
- Any product manuals
- Any instructional materials or presentations
- Use policies and standard operating procedures
- Data retention policies
- Letters of Interest
- Usage policies
- Any informal agreements or other documents that reference "ELERTS" or otherwise guide it use or the relationship between this agency and the provider or developer of the software.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

To whom it may concern,

In order to verify and clarify a bit on the nature my request, I am looking for all documentation involving Chicago Metra's contract with ELERTS Corporation (https://elerts.com/) - this contract was recently announced publicly on the Metra "On the Bi-Level" monthly newsletter: https://metrarail.com/about-metra/newsroom/metra-police-launch-app-reporting-safety-security-concerns

The article details: "The Metra Board of Directors on Wednesday approved a five-year, $274,000 contract with ELERTS Corporation to provide Metra with an incident reporting system for smartphones. The Massachusetts-based firm was the sole responsive bidder for the contracted work, which is being funded entirely by the FEMA Transit Security Grant Program."

I am looking for further documentation regarding this contract, with examples of possible pertinent documents listed in my original request.

We are contacting you regarding the above-mentioned FOIA Request, a response to which is due today. In that regard, we must inform you of your status as a Commercial Requestor and the time frame in which you may expect a response as allowed under FOIA. 5 ILCS 140/2 (c-10) defines "Commercial purpose" as "the use of any part of a public record or records, or information derived from public records, in any form for sale, resale, or solicitation or advertisement for sales or services..." Further, Section 3.1(b) of the FOIA requires a public body to give "priority to records requested for non-commercial purposes." 5 ILCS 140/3.1(b). As such, we are extending the due date of your commercial request to April 9, 2019.
