Metra is one of the largest and most complex commuter rail systems in North America, serving Cook, DuPage, Will, Lake, Kane and McHenry counties in northeastern Illinois. We are contacting you regarding the above-mentioned FOIA Request, a response to which is due today. We are in the process of preparing a response to your Request, however, while Metra always strives to provide requested information in an expedient manner, at times an extension may be required. In that regard, we must inform you of your status as a Commercial Requestor and the time frame in which you may expect a response as allowed under FOIA. 5 ILCS 140/2 (c-10) defines "Commercial purpose" as "the use of any part of a public record or records, or information derived from public records, in any form for sale, resale, or solicitation or advertisement for sales or services..." Further, Section 3.1(b) of the FOIA requires a public body to give "priority to records requested for non-commercial purposes." 5 ILCS 140/3.1(b). As such, we are extending the due date of your commercial request to April 9, 2019. Please know that Metra will strive to provide your documents ahead of the new, scheduled due date, but we cannot make special considerations or guarantee a faster response. Thank you for your patience as we process your Request.
