-The total number of cases pertaining to FOIA lawsuits brought forth in 2017.

On behalf of the City of Chicago Department of Law, I am responding to your Freedom of Information Act ("FOIA") request which was dated March 10, 2017 and received in our offices on March 12, 2017. You requested:

Requesting:

-The sum of expenditures the city of Chicago has spent on lawsuits in 2017 pertaining to Freedom of Information Act requests

-The total amount paid to plaintiffs pertaining to Freedom of Information Act requests in 2017

-The total number of cases pertaining to FOIA lawsuits brought forth in 2017.

Regarding your request for "the total amount paid to plaintiff pertaining to Freedom of Information Act requests in 2017," please note that the Law Department is not required under FOIA to produce records it maintains online. Under Section 8.5(a) of FOIA "a public body is not required to copy a public record that is published on the public body's website." The Law Department maintains a list of all settlement and judgment payments online at https://www.cityofchicago.org/city/en/depts/dol.html. The spreadsheet is under the section titled "Additional Information" in the file named 2017 Judgment & Settlement Payment Requests. You will have to sort the spreadsheet to find the FOIA litigation settlements and judgments. If you are unable to reasonably access the records online, please re-submit your FOIA request explaining why you are unable to reasonably access the records online as detailed in Section 8.5(b) of FOIA. Otherwise, the Law Department has no obligation to copy the records you seek because the records are already published online.

Regarding you other requests, our case management system lists that the Law Department opened 22 FOIA litigation cases in 2017. The Law Department also utilized outside counsel for one FOIA litigation case. The outside counsel is Richard Prendergast Ltd., and the case is Chicago Tribune v. City of Chicago Office of the Mayor, 15 CH 14058. The Law Department spent a total of $81,525.25 on this case in fees and expenses in 2017. The Law Department does not, other than the information provided above, track the sum of expenditures the City of Chicago spent in 2017 on FOIA litigation.
