Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

All communications by the Charlottesville Police Department Public Information Officer related to a social media video of SWAT personnel driving while recording video posted on Facebook on August 12, 2019. This should include any communication transmitting the video to the PIO, including forwards, and any communication from the PIO to any other department employee about the video. The video was likely recorded and posted sometime between August 8, 2019 and August 12, 2019.

Please also provide any documents related to the driver of the vehicle including daily drivers reports or logs maintained by the Charlottesville Police Department. It is believed that the vehicle is used by the Charlottesville Police Department SWAT team, and should sufficiently narrowly tailor the request.

As is required by General Order 517.08, please provide the approval of the video for posting on Department social media sites by any administrators of department social media for the video at the linked URL.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is a response to your Virginia Freedom of Information Act request received on February 4, 2019.

Please find all communication responsive to this request about the video referenced above, which are two (2) screenshots of text messages.

Documents related to the driver of the vehicle, including daily driver report logs maintained by CPD are being entirely withheld pursuant to Va. Code Sec. 2.2-3706 (B)(5). This information is a part of a specific tactical plan, disclosure of which would jeopardize the safety or security of law enforcement personnel or the public and Is exempt from release under FOIA.

We will refer you to our general order on social media for information on who has the authority to post to our pages, which can be found on our website charlottesville.org/police for your convenience.

The City will consider this FOIA request closed.
