Pursuant to the South Carolina Public Records Law, I hereby request the following records:

Records of all liquor displinary violations, drug disciplinary violations, reports of rape, reports of fondling, and reports of statutory rape from student residence halls dating from January 1, 2014 to December 31, 2019 (inclusive). I am requesting this information have the following information (but not limited to): exact date reported of the violation (e.g., the month, day, and year) and type of violation (e.g., liquor, drug, rape, fondling, statutory rape violation).

If this data can be given in a spreadsheet format (e.g., .xls, .csv, .xlsx) this would be most appreciated.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Dear Sir or Madam:

The College of Charleston has received your FOIA request on 1/31/21 for publicly available records concerning residence hall disciplinary violations for various offenses from 1/1/14 through 12/31/19.

With regard to your request, please be advised that the South Carolina Freedom of Information Act provides access to certain limited public records to citizens of the State of South Carolina upon request.

The College of Charleston does not actively share or release any information, unless required for compliance with applicable law.

It is noted that you are not a citizen of our State and that you represent an out-of-State entity.

Therefore, you lack standing under our FOIA statute to make a request for enforcement under our FOIA laws.

Further, pursuant to the South Carolina Freedom of Information Act, within Section 30-4-40(a)(2)material of a private and personal nature is not subject to disclosure under State law, as well as student records being protected from disclosure under FERPA, which includes both student records and student disciplinary records.

Therefore, any material designated to be within these categories or falling under the privacy exemption of FOIA cannot be provided.

Finally, we are required by law to notify you that any information requested under the South Carolina Freedom of Information Act in our State may not be obtained or used, "... for commercial solicitation directed to any person in this State." (See Section 30-2-50, S.C. Code Ann.).

Your request, as referenced above, is declined.

The above constitutes the final determination of the College regarding this matter.
