Pursuant to the state open records law, Ariz. Rev. Stat. Ann. Secs. 39-121 to 39-122 and 39-128, I hereby request the following records:

A list or log of U.S. Immigration and Customs Enforcement referrals made by the Chandler Police Department since January 2009 grouped by month, year, and reason for arrest, reason for referral, and whether ICE took custody of the arrestee or not. If no such log is kept, please perform a word search on the police reporting system, using keywords: Immigration, ICE and detainer, and provide copies of records that indicate a referral was made to ICE.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

If Chandler PD does not have log on ICE referral until fall 2012, I want to know how Chandler PD contacted and interacted with ICE when your institution manages and processes data or records on noncitizens with immigration or criminal violation charges in the jurisdiction before fall 2012.

I assume that Chandler PD has contacted ICE to process noncitizens with immigration or criminal violations before fall 2012, in compliance with federal-local partnerships (287(g)) and information sharing program (Secure Communities). If your institution has any related data or records, please provide them to me for my research.

As a researcher and doctoral candidate in the School of Public Administration at Arizona State University, my goal is to critically analyze U.S. immigration policy and related dynamics at the intergovernmental level. Your data contribution will be helpful for me to develop my research. Thanks.

Good afternoon Dongjae;

ICE referral's prior to the fall of 2012 were done so on a case-by-case
basis. Our Department did not have an officer 287(g) certified during
this time frame (2009-present). Any inquiries on an individual's
immigration status linked to a Chandler PD case would have likely been
completed at the jail by MCSO personnel when Chandler PD booked an
offender into jail for a criminal offense.

I have been unable to locate any documentation here at the police
department reference ICE referrals between 2009 and the fall of 2012.
