Pursuant to the California's Sunshine Amendment (Cal. Const. Art. I, § 3(b)), I hereby request the following records:

Request complete volunteer application file August 2013-present: professional/personal reference documents, volunteer form, LiveScan fingerprinting results and investigator and police department personnel
notes pertaining thereto.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

I am in receipt of your January 6, 2015 letter whereby you are asking for the complete volunteer application file August 2013-present: professional/personal reference documents, volunteer form, LiveScan fingerprinting results and investigator and police department personnel notes pertaining thereto.

The records that you sought are not public record. Release of personnel files would constitute an unwarranted invasion of personal privacy per California Government Code §§ 6254(c):

6254. Except as provided in Sections 6254.7 and 6254.13, nothing in this chapter shall be construed to require disclosure of records that are any of the following:
(c) Personnel, medical, or similar files, the disclosure of which would constitute an unwarranted invasion of personal privacy.

To the extent that there is a denial of some or all of the request for records, pursuant to Government Code §§ 6253(d) and 6255(b), Jane Mobaldi, Assistant City Attorney is responsible for the denial.
