To Whom it May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, ยง10, I hereby request the following records:

A request for all incident reports and complaints that have been filed at The Middle East Nightclub in Cambridge (472-480 Massachusetts Ave, Cambridge, MA 02139) in the last 20 years.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Perry Eaton

Mr. Eaton,

As a follow-up to your request, please note that our digital records are archived through 2004. Any relevant records prior to 2004 are available via paper copy only. As a result, any records beyond 10 years are more resource intensive and will likely lead to a higher estimated charge. With this background, please let me know if you would like to adjust your request.

Hello Jeremy,

Thanks for the speedy response. To make things more efficient, I'd be happy to just request all relevant records from 2004 to the present. Please let me know if this is possible.

Thanks!

Perry

Mr. Eaton,

It is estimated that it will take multiple parties from the Cambridge Police Department approximately nineteen (19) hours to process your request of all relevant records from 2006 through 2014. The applicable hourly rates are $15.45 ($15.45 x 12 hours = $185.40), $20 ($20 x 2 hours = $40.00) and $30 ($30 x 5 hours = $150.00). It is also estimated that three hundred and thirty seven (337) responsive documents exist, which can be copied for a fee of $.20 per page (337 x .20 = $67.40). Therefore, the total fee estimate is $422.80 ($375.40 + $67.40).

This amount is payable in advance of the City actually complying with your request. You may pay by check payable to the City of Cambridge sent to my attention.

This is an estimate. If the amount you pay turns out to be more than was necessary to comply with your request, you will be refunded the difference. If the estimate turns out to be too little, the City will comply with the request to the extent paid for and will submit a new estimate to you to complete the response.
