Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

Any documents detailing a security presence in public elementary, middle and high schools, including documents regarding police tactics in public schools and records of arrests/citations given to students

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is in response to your public records request for: “Any documents detailing a security presence in public elementary, middle and high schools, including documents regarding police tactics in public schools and records of arrests/citations given to students.”

Pursuant to 950 CMR 32.06(2), this is the written good faith estimate of the applicable search and segregation time costs that are payable before the City complies with your request.

It is estimated that in order to respond to your request that one (1) hour of employee time will be necessary, at an hourly rate of $47.00. Additionally, it is estimate that there are 13 responsive documents that can be copied for a fee of .20 a page ($2.60). As such, the total estimated fee is $49.60 ($47.00 + $2.60).

This amount is payable in advance of the City actually complying with your request. You may pay by check payable to the City of Cambridge sent to my attention.

This is an estimate for the search and segregation time costs. If the amount you pay turns out to be more than was necessary to comply with your request, you will be refunded the difference. If the estimate turns out to be too little, the City will comply with the request to the extent paid for and will submit a new estimate to you to complete the response.

Additionally, the Cambridge Police Department has also identified two other sets of documents that the Department is withholding pursuant to the Public Records Law: (1) Emergency Operations Plan, and (2) draft Memorandum of Understanding between Cambridge Public Schools and Cambridge Police Department.

In withholding the Emergency Operations Plan, the Department cites to M.G.L. c. 4, § 7(26)(b). Section 7(26)(b) of G.L. c. 4 applies to those records that are:

“related solely to internal personnel rules and practices of the government unit, provided however, that such records shall be withheld only to the extent that proper performance of necessary governmental functions requires such withholding.”

The Emergency Operations Plan relates to the internal workings of the City when responding to school emergencies. Information regarding the procedures used during these critical events could prove detrimental to the City’s critical response efforts, as knowledge of these practices could allow individuals to circumvent such procedures.

In withholding the draft Memorandum of Understanding between the Cambridge Public Schools and the Cambridge Police Department, the Department cites to M.G.L. c. 4, § 7(26)(d) – The Deliberative Process Exemption.

Section 7(26)(d) of G.L. c. 4 applies to “inter-agency or intra-agency memoranda or letters relating to policy positions being developed by the agency.” The exemption is intended to avoid release of materials that could taint the deliberative process if prematurely disclosed. The Department asserts that the release of the draft Memorandum of Understanding at this time could taint the deliberative process. As such, the Department declines to release the draft Memorandum of Understanding.

You are hereby notified that you may seek redress within ninety (90) days through the administrative process provided by the Supervisor of Records, Office of the State Secretary, One Ashburton Place, Room 1719, Boston, MA 02108. See M.G.L. c. 66, § 10(b); 950 C.M.R. 32.08.

Thank you for providing this fee estimate for this request. Please confirm your fee estimate, as it seems high, particularly since the lowest paid employee rate is $47.00. MGL requires the lowest paid employee to complete respective tasks for records requests -- please confirm that the lowest paid employee that can conduct the initial search for potentially responsive documents is paid $47.00. This is not a discretionary issue, but a statutory requirement for the lowest paid employee who is competent, capable and of proper clearance to conduct the search.
