Public Safety (SUDPS) received your letter on 10/13/20.  SUDPS deputies
receive their police powers under a Memorandum of Agreement with the
Santa Clara County Sheriff's Office.  Use of force data for SUDPS
deputies is maintained by the Santa Clara County Sheriff's Office. 
Santa Clara County Sheriff's Office will begin collecting racial
profiling data per CA state Assembly Bill 953 on January 1, 2021.

We would like to clarify your request for racial profiling data. Assembly Bill 953 took effect on January 1, 2021. Racial profiling data did not start being collected until the 1st. Do you want data for that day?

The Sheriff’s Office is in receipt of your California Public Records Act request. The data sought via your request is still being processed for “racial profiling data”. The Sheriff’s Office will maintain this request in its queue and provide this data to you when it becomes available. The Sheriff’s Office has identified one use of force record for Stanford DPS which we will release in accordance with the statutory requirements imposed pursuant to the passage of Senate Bill 1421 and the corresponding changes to California Penal Code section 832.7. The Sheriff’s Office requires time to appropriately redact and review the responsive records in accordance with Penal Code section 832.7. When the records are ready for release, you will be notified.

The Sheriff’s Office is in receipt of your request for racial profiling data “RIPA” information. At this time the data sought via your request is still being processed. The Sheriff’s Office will maintain this request in its queue and provide this data to you when it becomes available. Pursuant to AB 953, Section III, Item C, Law Enforcement Agencies must report by April 1 of the year following the collection of the data.

However, pursuant to the passage of Senate Bill 1421 and the corresponding changes to California Penal Code section 832.7. The Sheriff’s Office has located the attached record responsive to your request. As additional records responsive to your request become ready for release you will be notified and will be sent to you n a rolling basis.
